【摘要】 我们身处这样一个时代：巨大的社会转型和全方位的社会变革，使得今天的中国成为世界上最为丰富的“问题”来源地。对于这些有中国特色的，既是理论又是实践的难题，是开不出现成的药方的。征地拆迁即是这样的难题。笔者要追问的是，“尽管政府在各种场合表示征地拆迁困难重重，却为什么愿意并且能够以‘合理合法’的形式主导征地拆迁过程呢?” 本文选择农村迅速城市化的典型区域，也是笔者工作了十年的地方——C区作为个案研究的对象，以博弈论和利益相关者分析为研究工具，剖析征地拆迁过程中各利益相关者及利益博弈过程，探究矛盾纠纷存在的根源，形成“征地拆迁的实质是利益博弈”的基本观点。在此基础上，阐述政府在这场利益博弈中的主导性表现，并从观念和制度层面深度剖析“政府为什么愿意并且能够以‘合理合法’的形式主导征地拆迁过程”。通过上述层层解剖，最后得出结论：“利益冲突是征地拆迁纠纷存在的根源，利益冲突的焦点是征地补偿问题；征地拆迁的实质是利益博弈，这是政府在困境中依然愿意投身征地拆迁运动的原动力；强势的理念基础和复杂的制度环境的存在，则使政府能够以‘合理合法’的形式主导征地拆迁过程”，并着眼利益冲突的调整和政府行为的归正提出建议。 以征地拆迁这一难题本身的“盘根错节”和笔者既有的学识水准，是难以找到破解问题的现成答案的。因此，通过深入细致的微观考察，通过批判性的思考，通过理论和实证相结合步步深入的剖析，就征地拆迁这一当代中国的焦点问题，在认识上有所突破，在运用理论分析问题的能力上有所提高，从而对问题本身和“问题的背后”做出较为全面、合理和透彻的解释。这，也许就是本文研究的意义之所在。更多还原

【Abstract】 We are at such an ear with great social transformation and overall social reform, which makes China a problem source. There is no ready remedy for any theoretical and practical problems with Chinese characteristics. Land-takeover and pull-down is one of such problems. The author raises a question as follows: although the government shows great difficulties in land-takeover and pull-down at all circumstances, why it is possible for the government to take out the process reasonably and legally.This article takes C area, where the author lives and works for 10 years, as a case study. It is an area of typical modernization from a rural small town. This article analyzes the relative beneficiaries and studies the origin of dispute through game theory and analysis of relative beneficiaries, and then forms the basic argument of "game theory of benefits is the key of land-takeover and pull-down". On the above basis, this article analyzes the dominant role of government in the process and the reason why government take out the process reasonably and legally through conception and system. In conclusion, benefits conflict is the origin of disputes of land-takeover and pull-down; benefit game theory is the essential for land-takeover and pull-down, which is the impetus for government to get evolved in the difficulties; the existence of dominant conception and complicated environment makes the government play the key role in land-takeover and pull-down reasonably and legally, and also proposes to adjust the benefits conflicts and regulation of government behavior.It is difficult of find a ready solution for the difficulties with the complicity of the problem and the author’s knowledge. Therefore, this article focuses on the hot topic of ’land-takeover and pull-down’ and analyzes the problems and causes theoretically and practically to explain the matter at all-around way. which is also the purpose of this article.更多还原
