【摘要】 本文针对《中华人民共和国招标投标法》中“投标人不得以低于成本的报价竞标”的规定，对其研究现状做了分析，认为现行的判断方法都存在一定的问题，因此需要对此进行研究。 论文主要进行了以下研究： (1)探讨了建设工程施工投标人成本的构成，得出了工程价格必须以工程成本为最低界限的结论，为投标报价不得低于成本奠定了理论基础。 (2)对成本的定义和类别进行了分析，得出本文所指的成本从不同角度来看，分别是会计成本、企业个别成本、总成本的结论。并探讨了成本估算的现行方法，结合建筑工程分析了成本价构成。通过对建筑工程成本直接成本和间接成本的不确定因素的分析，从这两方面出发把影响工程成本的因素分为两大类，分别为影响工程项目社会平均成本的共同因素和导致企业间成本差异的个别因素，并对因素集进行细化分析。 (3)建立影响投标项目社会平均成本和企业投标项目个别成本综合修正系数因素体系，并进行特征因素量化，应用于人工神经网络模型。利用已有工程实例来训练模型，仿真的结果显示，基于变结构神经网络模型预测企业个别成本有一定的实用价值，并且其网络结构、收敛性优于BP神经网络。 (4)界定建设工程施工投标人成本的根本目的是防止投标报价低于成本的投标人中标。因此，在评标过程中，可以用企业定额、市场价格信息体系相结合评判方法，借助造价软件算出分部分项工程综合单价的合理范围，从而评判投标人报价是否合理，剔出低于成本报价者中标。 (5)提出了防范投标报价低于成本的投标人中标的综合措施，从宏观和微观两个方面研究如何防范低于成本价中标。其中宏观从五个方面研究，这五个措施分别为政府管路模式的转变，健全市场监督及约束机制，计价方式的改革，提供企业自主报价的良好环境，转变造价管理部门职能。这些措施主要是从客观上来防范投标人低于成本价投标甚至中标。微观从资格审查、招标文件、评标工作、执行合同和实施工程保险转移风险五个方面研究了招标人应采取的措施。其中，资格审查主要是为了保证投标人有可靠的资质参与投标；招标文件的相关规定一方面是为了防止投标人低于成本报价，另一方面是为了要求投标人提供相关证据更多还原

【Abstract】 According to the 33th article in the "Bidding and Tending Law of the People’s Republic of China", the research actuality is analyzed and more research is needed to be done according to actuality.The thesis mainly obtained to draw a conclusion:First, relation between cost and price is discussed and the conclusion that cost is the lowest limit of price is educed.Second, cost is analyzed from various angles and conclusion is made that the cost in this dissertation is accountant cost, individual cost and general cost. And through analysis to the indetermination factor of the construction engineering cost direct cost and the indirect cost, It points out the factor influencing construction cost.Third, analyses the factor influencing construction cost and judges the design of network structure, discusses the superiority of the predicting model of varied structure artificial neural network and study algorithm, etc.Fourth, in the process of judging mark, put enterprise’s ration and market price information system into judging whether construction bid price going below construction cost.The ultimate intention of judging whether biding price under cost or not is to prevent bidder whose biding price is under cost from winning of bids. So integrative measures are advanced to prevent such situation. And measures adopted by government and tender are included.更多还原
