【摘要】 现行土地征收补偿制度是计划经济时代的产物,在市场化改革与发展的今天,其与土地的资源性特征、集体土地所承担的功能和开发利用的现状明显不符。制度的滞后不仅使农民及农民集体的合法权益无法保障,与此相关的土地征收制度更是成了我国当前经济社会持续发展的制度障碍。因此对现行土地征收补偿制度进行理性分析,在制度上对之进行合理的构建是必要的,在建设统筹发展与法治社会的今天也是可行的。文章在对土地征收补偿制度的法源基础和域外征地补偿制度进行考量后,根据我国的国情,指出完善我国土地征收补偿制度的两个基本价值目标——维护土地征收的可持续性和促进土地征收中的城乡统筹发展。在此基础上就如何完善集体土地所有权主体制度,确立土地征收的合理补偿原则,建立科学、公正、合理的收益分配制度和建立健全征地补偿的救济制度等法律问题展开论述,以求有益于土地征收法制建设与征地实务的完善。更多还原

【Abstract】 The present systems of expropriation of lands and compensation for peasants are the outcome of the Age of the Planned Economy, and they are obviously not corresponding with the characteristics of land as a kind of resources and the function burdened by collective lands and the use and development of land. The inefficient systems not only make the legal rights of peasants and their collective is not guaranteed, but also make the related systems of expropriation of land and compensation for peasants become the obstacle to continually develop the economy and society in our country. So it is necessary to analyze rationally the present systems and to construct reasonably new systems based on the old ones, and it is also feasible to do so in the situations of construction and development as a whole. After analyzing the base of the source of law of the systems and the overseas systems, according to the situations in our country, the writer set up two basic value aims for improving the systems of expropriation of land and compensation for peasants. These two basic aims are to maintain the continuity of the expropriation of land and to accelerate the development of city and country as a whole in the process of expropriating land.Then the legal problems that how to improve the systems of main body of ownership of collective land, to set up the reasonable principle of compensation in the expropriation of land, to build scientific and fair systems of distribution of profits, and to build and strengthen the systems of relief in the expropriation of land and compensations for peasants, and so on, are discussed on the base of the two basic aims.
