法律信仰实现的社会机理研究

【摘要】 法律信仰的实现不是或不只是一个法律问题，可以说是一个有关经济、政治、文化的综合互动。研究法律信仰必须把握和揭示其得以实现的深层社会文化基础，系统分析和解读法律信仰的实现与社会经济、政治、文化之间的内在联结关系。 本文从经济、政治、文化三个角度探讨了法律信仰的实现机制。首先，自然经济是一种封闭、保守的经济形态，其本质是排斥法律的，所以它的法律条文根本不能赢得人们的普遍信仰；计划经济是一种意志经济、权力经济，它迫使人们远离法律，对法律的信仰更是无从谈起；商品(市场)经济是通过市场机制分配经济资源的交换经济，它促成了从血缘到业缘、乡土社会向契约社会的转变，培育了平等、自由的价值观及个人独立关系，为法律信仰的实现铺设了经济前提。其次，在传统的专制政体中，本来应当受到法律限制的权力，却凭借自己的某种身份不受制约的膨胀，法律则被置于次要的地位，在这种社会里，法律信仰是无法形成的；民主政治是法治的内在要求，它内含的原则有利于保障人们基本权利和自由的获得，从而使人们逐渐亲近法律，最终信仰法律。最后，以性善论为主导的人性预设、以群体为本位的家族观念、法律文化伦理道德化、理性意识的缺失是我国传统社会文化制度的典型特点，在这种情况下，道德信仰高涨，法律信仰无从谈起。在现代中国特色的社会文化中，法律体现了人的本质要求，并获得现代道德的认同，权利意识深入人心，社会公众特别的珍视和爱护法律，这就为法律信仰的实现创造了良好的文化环境。更多还原

【Abstract】 Legal belief is not or not only a legal issue, but can be said to be integrated with the economy, politics, and cultural. Researching the legal belief we must grasp its social and cultural attainment basis analyse and interprete the relation between the legal belief and the society, economy, politics and culture.The thesis discusses the legal belief realization mechanism from the economic, political and cultural angles. Natural economy is a closed, conservative economic pattern. It excludes the law in essence and can not win people’s universal belief. Planned economy is a will economy or power economy. It forces people to stay away from the law as to the legal belief is impossible. Commodities (market) economy is the exchange economy which distributes the economic resources through the market mechanism. It contributes to the transformation from strain to profession, rural society to contractual society and cultivates the values of equality, freedom, individual independence. All of these are the economic premises for the realization of legal belief. In the traditional autarchy regime, the power which should be limited by law expands without restriction. The law is in the secondary position. In this society, people can not form legal belief. Democracy is inhere demand of rule of law. The principle of democracy is propitious to protect basic rights and freedom. It promotes people to hobnob with law, finally believe in law. Humanism hypothesis of good, kindred conception of colony first, morality law culture and lack of logos consciousness are representative characteristics of traditional culture. In this situation, moral belief is run up, legal belief is inundated. In the modern Chinese characteristic culture, law materializes inbeing request of human being, it wins moral self-identity, right consciousness goes deep into people’s heart; the public will especially prize and cherish law, then will trust in and believe in law.
