WTO/TBT通报咨询制度研究

【摘要】 技术性贸易壁垒是当今我国学者研究的重点领域。应该说，我国学者在有关WTO技术性贸易壁垒方面的研究成果也是比较丰硕的。遗憾的是我国多数研究WTO的学者只是着眼于从宏观的角度去研究TBT，而在TBT的具体细节方面的研究还比较少，特别是在《TBT协议》中占有重要地位的通报、咨询制度方面的研究更少。 TBT通报、咨询制度是实现WTO各成员的技术性贸易壁垒措施透明化和信息互换的重要保障，对保障国际贸易的顺利进行发挥了重要作用。全文由导言、通报咨询制度概述、通报咨询制度一般性研究、WTO《TBT协议》通报咨询制度的缺陷、我国TBT通报、咨询网络建设现状与构建以及结束语共六部分组成，共3.5万字。 导言简单阐述了技术性贸易壁垒对国际贸易造成的影响以及选题理由。 第一部分首先分析了TBT通报、咨询的概念。TBT通报咨询的概念问题，还没有引起中外学者的注意，就连WTO也没有给出一个权威的定义。作者指出应该结合《TBT协议》的宗旨、规定通报、咨询制度的目的和通报、咨询制度的作用几个方面才能给通报、咨询作出一个比较明确的定义。作者在本部分中指出：在第二节中详细阐述了TBT通报、咨询的原则以及TBT通报、咨询原则的特征。在TBT通报、咨询原则的特征这一节，主要分析了具体的特征以及理由。第三节主要分析TBT通报、咨询制度与国家立法权的关系。本节从两个方面分析了它们之间的关系：对国家立法权的限制；“有约必守”原则的例外。 第二部分主要从四个方面对TBT通报咨询制度进行了分析：通报的分类、通报的内容、通报咨询的程序以及TBT咨询点的设立。在通报的分类中，通报分为：正常通报、一般通报、紧急通报和预先通报，并对应该如何分类作了分析。通报的内容，主要分析各成员应当通报的内容。有关通报咨询的程序问题，通报咨询应当严格按照《TBT协议》规定程序，以及不遵循规定程序可能引起的后果。为了保证通报咨询的顺利进行，WTO规定各成员必须设立至少一个TBT咨询点来具体承担通报咨询的工作。 在第三部分中，作者主要分析了WTO《TBT协议》通报咨询制度存在的更多还原

【Abstract】 TBT notification and enquiry play an important role in keeping WTO Contracting Parties’ technical barriers to trade transparent, and promoting the international trade. As we all know, the technical barriers to trade (TBT) are an important field of domestic researchers’ study. We have got affluent researches in WTO TBT. But it is a pity that most researchers focus on the macrocosm aspect of TBT, but there is little research on the microcosm aspect, particularly less on the TBT notification and enquiry which play a big role in the TBT Agreement.This essay is composed of six parts, including the preface、 the general statement of TBT notification and enquiry system、general study on TBT notification and enquiry system、 the deficiencies in TBT Agreement、 the construction of our nation’s TBT notification and enquiry system and the termination.The first part: The writer analyzed the conceptions of TBT notification and enquiry and pointed out that there was no authoritative conceptions of notification and enquiry, then the principles and the characteristics of the principles of TBT notification and enquiry. At last the writer also analyzed the relationships between the TBT notification and enquiry and Contracting Parties’ legislation. In the one hand, the TBT notification and enquiry system impose an limitation on the Contracting parties’ legislation, but on the other hand there are exceptions.In the second part, we mainly discussed four parts, including the classification、 contents、 procedures and the enquiry stations of TBT notification and enquiry. About the classification, it is composed of four parts, including normal notification、 general notification、 emergency notification and preliminary notification. About the contents, it is mainly about technical regulations、 standards and the conformity assessment procedures.更多还原
