完善我国专利制度对技术创新的支持系统

【摘要】 第二次世界大战后科技的迅猛发展给人类带来巨大的变化，特别是当今社会，科学技术成为第一生产力。发展本国的科学技术已成为世界各国的重要任务。因此，技术创新作为获得技术进步的重要途径也理所当然得受到世界各国的重视。技术创新是一个复杂的系统，它的完成需要各个方面的支持。专利制度作为一个重要的支持系统发挥着独一无二的作用。本论文希望通过对专利制度支持技术创新系统的理论研究，为完善我国专利制度对技术创新的支持系统提供一些具有可行性的实践措施，以加快我国技术创新的步伐。同时，促进我国创建创新型国家的步伐；完善我国民主法制建设和依法治国。 首先，从技术创新和专利制度的含义入手，明确研究问题前最基本的概念问题，通过分析技术创新与专利制度的关系，让人们认识到技术创新与专利制度的辩证关系。然后通过劳动理论、人格理论和激励理论的探讨说明了专利制度对技术创新的支持具有充足的正当性。随后，进一步阐述了完善专利制度所产生的重大意义。 其次，本论文在分析了专利制度对技术创新支持系统的前提下，揭示了在专利制度中存在的不利于技术创新的四个方面。针对这些问题，论文从哲学的角度深刻分析了造成这些现象的原因。 最后，在分析造成专利制度出现不利于技术创新现象的原因之上，本论文尝试提出了完善专利制度对技术创新支持系统的四大原则：激励原则、法制原则、平衡原则以及科学发展观原则。通过这四大原则的确立，为我国完善专利制度对技术创新的支持系统提供一个纲领性的指导。最后，在针对前文原因分析和指导原则的前提下提出了具体的完善措施。更多还原

【Abstract】 The rapid progress of science and technology have brought human great change since World War Ⅱ, especially in modern society science and technology becomes the first productivity. Developing the homeland science and technology is every country’s important aim. Therefore, technical innovation, as the main approach of technical advancement, is certain to be thought much by all of countries. Technical innovation is a complicated system, its completion needs supporting systems of various sides, patent system, as an important supporting system, plays an unparalleled part. In this thesis through the theoretical research of patent system supporting technical innovation system, some feasible measures which will quicken the steps of technical innovation are brought forward. At the same time, the measures will be helpful to build up our country an innovative country; the measures will also perfect the construction of democracy and law system and bring managing state affairs lawfully into effect.Firstly, started with the meanings of technical innovation and patent system, essential concepts are made clear before the question is studied. Through analyzing the interaction relationship between technical innovation and patent system, the dialectic relationship between the two factors will be clearly recognized. Then patent system supporting technical innovation has powerful validity by means of labor theory, personality theory and prompting theory. The important significance of perfecting patent system is set forth subsequently.Secondly, under the premise of analysis of patent system supporting technical innovation system, four aspects of patent system will go against technical innovation. The reasons are profoundly analyzed philosophically.Finally, on the basis of analyzing the reasons that patent system goes against technical innovation, four principles which perfect patent system supporting technical innovation are tried to bring forward: prompting principle、law principle、 balance principle and scientific development view principle. The four principles supply patent system supporting technical innovation system with guidance of a general outline. In the end idiographic perfecting measures are given under the premise of foregoing reason analysis and the guide rule.更多还原
