【摘要】 WTO争端解决机制是在GATT争端解决机制基础之上形成的，是当代国际经济中独特、新颖、复杂的争端解决制度。政治方法和法律规则的融合运用是这一机制的显著特点。我国已经加入WTO，该机制必将全面影响我国国际贸易发展，深入研究这一机制并提出相应的对策是我国正确适用争端解决机制保护自己贸易利益的有效手段。国内关于这一机制的研究已经取得了相当的成果。本文主要是以《WTO争端解决规则及程序的谅解》(《Understangding on Rules and Procedures Governing the Settlement of Disputes，DSU》)为基础，从法律的角度研究了其主要程序规则，结合案例，分析了程序规则的优点和不足之处。重点研究了专家小组程序，上诉审查程序以及在实践基础之上发展起来的证据规则。多哈回合谈判是正在进行的新一轮WTO多边贸易谈判，本文结合关于争端解决机制问题各国的提案，指出了各国对争端解决机制的关注和展望。同时，我国对于这一机制的发展与改进也有自己相应的观点。通过对以上问题系统地分析比较研究，指出我国有效适用这一机制的对策。更多还原

【Abstract】 Dispute settlement mechanism (DSM) of WTO which transformed on the foundation in GATT is the distinctive ,new and complex dispute settlement in the contemporary international economic dispute settlement. Political method and law regulation which are both used in this settlement is the remarkable characteristic of DSM.China has already entered into WTO, whose mechanism will influence the developments of international trades of our country comprehensively. In order to master the DSM to protect our international trades, we should research the DSU to find the countermeasures. The domestic research in the mechanism has already received some production. This text is mainly based on <Understanding Rules and Procedures Governing the Settlement of Disputes> to research the procedure rules with legal analysis and cases.Panels ,SAB and proof rules are the key research in this essay . Doha is the afoot new rounds of WTO Multilateral trade negotiation. Various countries mention the agenda to concern and develop the mechanism . Meanwhile, China has its own corresponding views to the development and improvement of this mechanism . Through analyzing the above problem systematically , we point out the countermeasures that how to apply the mechanism effectively.更多还原
