【摘要】 法律文化研究是法学研究中的研究视角之一,然而有关经济法文化的研究相对来说是一个薄弱的环节。这一方面可能由于法律文化理论的抽象和不易把握,另一方面也可能是由于从事基础理论研究的艰难造成的。但是,经济法学的产生发展受其法律文化的深厚影响,研究经济法的过程中有必要对经济法文化作基本的理论研究。中西方经济法产生于不同的时代背景,其传统文化基础差异显著。笔者从文化、法律文化、法律文化的冲突与变迁以及经济法制度的法律文化土壤的思路进行研究,在理论分析的基础上,基于经济法形成与发展的特定背景与现实,阐释经济法以社会本位为价值取向、以权利与权力均衡为主旨、以平衡协调为内核、以人为终极关怀的内涵;经济法文化的路径考察由经济法文化演进与国家角色的变迁、经济法嬗变中的平衡协调精神、经济法文化孕育中的社会本位思潮、经济法文化熏陶下的经济法制度催生四个层面展开;经济法文化的特性表现为现代性和民族性,经济法文化与现代法治文明的关联涵盖两个方面,挖掘发扬传统法文化中的合理因素、警惕传统法文化中不合理因素的侵蚀;由于中西经济法文化的产生与发展存在一定的差异,西方经济法文化的发展表现为权利文化向权力文化的过渡转型,笔者以德国和美国经济法发展的历史性回顾与反思进行实证考察并结合西方的法社会学思潮研究与西方经济法文化的内在联系,同时围绕东方经济法文化进行探析,其表现形式是儒家文化,发展的过程表现为权力文化向权利文化的转移,其中中庸文化是中国经济法文化的底蕴。本文研究的目的及意义乃是从理论上探讨我国现代经济法文化的培育与构建;我国经济法文化构建的目的是维护社会整体利益,其中伴随着利益的冲突与妥协,利益衡量的视角是自然人、经济人、生态人的演进;我国现代经济法文化构建的维度包括静态与动态结合、多元化和多维度递进、观念与制度互动并从宏观调控法、市场规制法、社会保障法三个层面加以展开。更多还原

【Abstract】 One of the research visual angle while studying law is legal culture , but the research about the culture of economic law is a feeble tache. Respect this perhaps because law cultural abstract and difficult assurance of theory, on the other hand or cause what has been engaged in basic theoretical researched difficultly. However, the formulation development of economic law science receives its legal culture’s deep influence, course to study economic law act as the basic theoretical research to the culture of economic law while being necessary.The China and Western economic law evolves from different eras background , its basic difference of traditional culture is prominent . I, through comparing the research approach to analyze with the case, from culture, legal culture, legal changes and lead legal culture into meaning in which the economic law study set out of culture, on the basis that the theory is analyzed, particular background and reality formed and developed on the basis of the economic law, study and regard power culture and right culture as the economic law culture of two major key elements among them from the standing of angle of legal culture. From the meaning of the culture of economic law at the same time, necessity and feasibility of studying in culture of economic law, economic law characteristic modernity and national characteristic of culture,, economic law culture with modern to rule by law civilized angle set about , carry on economic law analysis of culture; Secondly, certain difference exists in formulation and development of Chinese and Western economic law culture, the development of the culture of western economic law is shown as the cultural transition to power culture of the right rotates.
