企业国有产权转让机制初探

【摘要】 企业国有产权转让机制是指一系列与企业国有产权转让相关的程序、配套制度安排和运行规则。它将企业国有产权转让的各个环节和相关主体融合成为一个有机的整体。 本文从企业国有产权转让的基本认识入手，对企业国有产权转让的概念、转让的形式、原则、程序及现实作用进行了概括性的描述和分析。在此基础上，文章将企业国有产权转让在明晰产权、公开市场化操作以及监管方面的特点与一般性的产权转让相区别，并选择从企业国有产权界定机制、企业国有产权交易市场机制、企业国有产权转让价格机制和企业国有产权转让监管机制四个方面入手，对产权转让进行深入分析。同时，在分析中将它们相互渗透融合，意在体现出其整体性。本文还介绍了现阶段企业国有产权转让的发展状况，并以机制分析为思路，总结了在产权界定、市场环境、法制环境、政府行为等方面存在的问题，解释了其内在的原因。文章最后，以培育完善的企业国有产权转让机制为目标，有针对性地提出了解决问题的具体建议。更多还原

【Abstract】 The transfer mechanism of state-owned property rights in enterprise means a system of procedure, institutions and regulations about the transfer state-owned property rights in enterprise. It makes many links and main parts which relative to the transfer of state-owned property rights in enterprise as a organic whole.The article starts with the basic recognition on the transfer of state-owned property rights, and gives a universal analysis on conception, form, procedure and realistic function. Based on it, the article finds out the transfer of state-owned property rights in enterprise is different from the others. It has its characteristic on clarity of property rights, transfer marketization and supervision. The article makes a deep analysis on the transfer of state-owned property rights in enterprise from four aspects. It contains the mechanism of limit, the mechanism of price, the mechanism of market and the mechanism of supervision. During the process of anaysis, the four parts make the transfer of state-owned property rights in enterprise as a organic whole. The article also introduces the present situation of the transfer of state-owned property rights in enterprise, and summarized problems on property rights limit, the market enviroment, the law enviroment and the state activity, then explains reasons of these problems. At last, the article gives suggestions which will be beneficial for perfecting the transfer mechanism of state-owned property rights in enterprise.更多还原
