【摘要】 中共三代领导核心结合各个历史时期的革命任务和时代要求，适时做出关于民主法制建设方面理论探索和实践决策。 毛泽东民主法制理论和实践横跨新民主主义和社会主义两个革命阶段，择其要点包括：确立了人人平等的原则；从防止人亡政息出发，让人民监督政府；创立人民民主专政理论，确立了符合国情的国体；创立人民代表大会理论，确立人民当家作主的政体；从理论上重视宪政，领导制定新中国第一部宪法。 邓小平民主法制理论和实践是对毛泽东民主法制理论的继承和发展，是党和国家关于民主法制建设的原则、方针、政策和理论的集中的体现。择其要点包括：社会主义民主与法制的地位和作用；坚持人民民主专政，发挥国体作用；发展与中国国情相适应的社会主义民主；健全和发展有中国特色的社会主义民主制度；社会主义法制要按法制基本要求办事。 江泽民民主法制理论和实践是与毛泽东、邓小平的民主法制理论一脉相承的，它集中体现依法治国理论，是三代领导核心民主法制理论的结晶，是我国社会文明进步的重要标志。择其要点包括：确立依法治国方略理论和实践基础；为国家长治久安，不断推进民主法制进程；依法治国，建设社会主义法治国家。更多还原

【Abstract】 According to the revolution mission and the request of the ages of history, the three generations of leadership core of the CCP have bent themselves to probe into the theories concerning the democracy and legal system construction in good time, made right policies to guide the practice.The democracy and legal system theories and fulfillments of Mao Zedong cross new two revolution stages of new democratism and socialism, which includes: establishing the equal principle of everyone from the theories and practice democracy and legal system construction in the revolution base; letting the people supervise the government in order to turning away country perdition; establishing the theories of the democracy and autocracy of the people, establishing the state of the nation according with the situation of our country; establishing the people congress theories, the form of government that insures the people to take charge of the country and make decision by themselves; attaching importance to the constitutional government in theory, leading to establish the first constitution in China.The democracy and legal system theories of Deng Xiaoping succeed to and develop logically that of Mao Zedong, they are the concentrated embodiment of CCP and our country concerning the principle, guideline, policy and theories of the democracy and legal system construction , which includes mainly: the position and the function of the socialism democracy and legal system; sticking to the democracy and autocracy of the people, developing the function of constitution; developing the socialism democracy according with the situation of our country; consummating and developing the socialism democratic system with Chinese special features; handling affairs according to the basic request of socialism legal system.The socialism democracy and legal system theories and practice of Jiang Zemin, come from Deng Xiaoping’s democracy and legal system theories and fulfillments directly. Governing the country under the rule of law is the crystal of the democracy and legal system theories of three generation leader cores, a progressive important marking of social civilization of our country.
