【摘要】 学习权是人们所应当享有的基本权利，终身学习理念的深入影响和学习化社会的全面构建使学习权的充分实现成为可能。成人学习权是成人学习者充分利用各类学习资源、满足自身的求知和发展需求的一项基本权利。成人教育是终身教育体系中跨度时间最长、涉及范围最广的一个重要领域，加强对成人学习权的法律保障是构建学习化社会的法制基础。因此，必须完善成人教育法律法规，在立法中确立和保障成人学习权，为成人教育各项活动的开展提供良好的法制环境。本文正是基于这样的出发点，对成人学习权及其立法保障问题，分五章进行论述： 第一章：绪论。本章主要介绍了研究的缘起、背景、国内外相关文献的研究综述，并且明确指出了研究成人学习权不仅有利于拓宽和深化成人教育学的研究领域，更有利于推动成人教育学科建设、完善我国成人教育法制体系。 第二章：成人学习权的发展历程与内涵。本章考察了成人学习权理论的发展历程，突破了传统受教育权理论在构建学习化社会的背景下，在权利涉及的范围、权利主体的地位、权利的性质以及权利的内容等四个方面的局限性，并对成人学习权的概念进行了科学的界定，丰富了学习权理论的内涵，从而明确提出构建学习化社会必须加强对学习权尤其是成人学习权的法律保障。 第三章：成人学习权的理论基础与价值取向。本章根据权利本位理论、教育平等理论、学习自由理论以及人的全面发展理论，明确提出成人学习权的三大价值取向：平等、自由和人的全面发展。这三个价值取向是成人学习权的权利体系架构的理论支撑，也是必须在立法保障中贯穿始终的立法精神。 第四章：台湾地区成人学习权的立法保障分析。本章在前面理论研究的基础上，以我国台湾地区的成人教育立法为例，从立法目的、学习者、学习内容和方式、管理体制、实施机构、师资与经费和学习成就认可这七个层面，首次全面系统地梳理分析了台湾地区成人教育法律法规，总结其立法保障的三大特点，考察成人学习权的三大价值取向在其中的具体体现。这些都为我国大陆地区成人教育的法制完善提供了重要启示。 第五章：成人学习权的权利体系界定与若干立法思考。通过前述研究确定成人学习权的内涵、明确成人学习权的价值取向，并在借鉴台湾地区立法经验的基础上，本章主要对成人学习权的权利体系进行架构，提出成人学习权应包括五个“子权利”，即学习机会平等权、个性发展权、学习条件主张权、获得帮助权、学习成就认可权，以及相对应的十四个“孙权利”，进而为完善成人学习权的法律保障提出几点思考。更多还原

【Abstract】 With deep development of lifelong education, lifelong learning, and learning society, people constantly get much wider and further in comprehending learning right. As a basal right, learning right should remain with everyone.Establishing learning society makes learning right adequately come true.Adult learning right is such a basal right that people can make the best of all kinds of learning resources and can satisfy their requirment of learning and development. Adult education is a very important field in lifelong learning system which spans longest and widest. Intensifying legislation of adult learning right is foundation of establishing learning society. Therefore, laws and rules of adult education must be perfected so that adult education have a good environment for development.Based on this start, my thesis fix attention on adult learning right and how to intensifying legislation of it. The main contents of the thesis are as the following:Chapter one:Exordium. As the threshold of the thesis, this chapter mostly introduced the origin and background of the research, summarized relational research literature both inside and outside our country, and pointed out the significance of this research.Chapter two:Development and essential of adult learning right. This chapter saw , about the development of adult learning right, and defined the conception of adult learning right. With coming of learning society, traditional right of receiving education gradually emerges its insufficiency. It is my thesis’s duty to break through the localization of right of receiving education, and enrich the essential of adult learning right. And it is more clearly that perfecting laws of adult education is guarantee of establishing learning society.Chapter three:Theory foundation and value tropism of adult learning right. On the base of right standard theory, education equality theory, free learning theory and roundly person development theory, adult learning right take its value tropism as equality, freedom and roundly person development. These three value tropism are emphases which legislation should focus on. And they are also supports in constructing right system of adult learning right.Chapter four: Legislation research of adult learning right in Taiwan. My thesis takes Taiwan adult education legislation as an example.This chapter analyzed the laws and rules of adult education in Taiwan, discerned the three value tropism in them ,and sumed up the characteristics. All these provided important revelation to adult education legislation in our mainland.Chapter five: Right system and legislation idea of adult learning right. After knowing the essential and value tropism of adult learning right, and getting experience of adult education legislation from Taiwan, in the last chapter, we can construct the right system of adult learning right and bring forward several ideas of maintaining adult learning right.更多还原
