【摘要】 在知识经济时代，知识产权正成为这个时代的一个最重要的象征。知识产权的重要性日益为各个国家所认识，无论是发展中国家还是发达国家都已经把知识产权作为自己参与全球经济技术竞争的一个重要战略提上了自己的议事日程上来。知识产权和技术创新的关系极端密切，而创新又是一个国家发展的灵魂，因而合理的知识产权制度可以不断提升一个国家的技术创新能力。研究知识产权已经成为各个国家的一个重要课题，对于发展中国家来说更显得犹为迫切。 这个时代也是一个经济与技术全球化、一体化的时代，知识产权也不例外。对于发展中国家来说，知识产权制度的建立和发展既是其经济发展的内在需要，同时也是经济全球化的必然结果——发达国家出自于保护自己经济利益的需要，对发展中国家不断施加各种政治和经济压力，要求发展中国家对知识产权实施保护并不断加大其知识产权保护力度。TRIPS协议的达成体现了知识产权保护的国际化趋势，知识产权政策已不仅仅是一国国内的政策了，而要受到许多外界条件的约束。 知识产权保护国际化对发展中国家就意味着，需要提高本国的知识产权的保护水平，使其逐渐达到和发达国家的相同的保护水平。相对于发达国家来说，发展中国家的技术创新能力非常不足，在这种情况下，提高发展中国家的知识产权水平势必会对发展中国家的经济产生重大的影响。而对于究竟会产生怎样的影响，是利是弊，我们却并不清晰，这也同样是作为诸如中国这样的发展中国家最为关心的问题。 出自于以上的考虑，本文对加强发展中国家的知识产权保护有可能产生的一些主要经济效应进行了分析，得出的一些结论主要如下： 首先从理论模型的角度分别就封闭经济和开放经济条件下，加强发展中国家的知识产权保护的经济效应进行了分析。封闭经济条件下，在一国的知识产权保护水平会影响到该国的技术溢出强度这一视角下，分析了知识产权保护水平对企业创新激励的影响，从而会进一步影响到该国的技术创新水平。得出的结论是：一国的知识产权保护水平和该国的技术创新水平是一种倒U形关系，即当一国的知识产权保护达到一定的程度时，提高知识产权保护水平反而会降低该国的技更多还原

【Abstract】 At the "Knowledge-based Economy" time, Intellectual Property Rights has become one of the most important symbols of this age. The importance of Intellectual Property Rights has been known by all countries of the world, both developed countries and developing countries regarded Intellectual Property Rights as a very important strategy for them to compete in this world. Intellectual Property Rights has a very close relationship with technology innovation, and innovation is the soul of a country, for this reason, a good Intellectual Property Rights regime can improve the ability of technology innovation of one country. Research Intellectual Property Rights has become a more and more important topic now, and it is urgent for developing countries.This age is also a globalization and integration age of economy and technology, it has the same meaning for Intellectual Property Rights. For developing countries, the construct and develop of Intellectual Property Rights regime is not only necessary fortheir economic growth, but also the result of economic globalization------developedcountries exerted all kinds of pressures to the governments of developing countries for their own interests, and forced them to protect their intellectual property rights and enhance their level of their protection standards. The conclusion of TRIPS is a symbol of internationalization of intellectual property rights protection, now the policy setting of intellectual property rights is not only a business within a country, it is also subjected to other factors outside.The internationalization of intellectual property rights protection to developing countries mean that they need enhance the level of intellectual property rights protection, even reach to the same level with developed countries in the end. Comparing to developed countries, the ability of innovation of developing countries is very weak, due to this reason, strengthen the intellectual property rights protection of developing countries, it will bring great effects to their economy and development.
