【摘要】 本文首先提出离婚损害赔偿请求权产生的理论依据问题,其次分析了离婚损害赔偿的构成要件,最后明确了如何实现并完善离婚损害赔偿制度。全文遵循以上提出问题、分析问题、解决问题的脉络,对2001年《中华人民共和国婚姻法》(以下简称《婚姻法》)第四十六条中的离婚损害赔偿制度及相关问题作了较全面、系统的阐述。文中通过对违约责任说及侵权责任说的观点介绍及评析,论述了离婚损害赔偿是基于对配偶权的侵犯而产生的。虽然我国的《婚姻法》中没有明确规定配偶权的概念,但某些条文却体现了配偶权的内容。为了更好地保护无过错配偶的权利和更优地发挥离婚损害赔偿制度的作用,笔者建议,应在《婚姻法》中明确规定配偶权。离婚损害赔偿不仅具有一般侵权损害赔偿的构成要件还具有其特有的构成要件:即以离婚为前提。论文的最后一部分以我国离婚损害赔偿制度实施以来,司法实践中反映的问题为线索,对家庭其他成员不能请求离婚损害赔偿、第三者不在离婚损害赔偿中与过错配偶承担连带责任、受害配偶举证责任问题及损害赔偿数额的确定等问题进行了探讨。更多还原

【Abstract】 Marriage Law is the law which most close to ordinary people living, and compensation system of divorce damages is a major relief system in Marriage Law. With the development of society, some of the negative sides of social phenomena are uncovered, "extra-marital relationship", " taking concubines", "family violence " and other bad phenomenon have been greatly harming marriage and family relations. Accompanied by improved quality education, legal concepts, awareness and subject is growing step by step, law experts discuss how to use the weapon of law to safeguard the legitimate rights and sanctions the people who undermine marriage and family relations, so divorce damages system established in 2001. The article on this system and related issues explored simplely.Chapter one is the background of divorce damages system. Through social background and legal background the chapter expounded that marriage law of chinese is relative imperfect and the problems of social realities, to solve these problems, divorce damages system came into being. First, through detailed data descript the information to the social realities of our current situation, bigamy, "taking concubines", family violence and other undesirable phenomenon lead to countless marriage and family dissolution, it spouses enormous harm from physical, property and the mental, and may even trigger a violent crime in a criminal case.
