【摘要】 随着国家间交往的频繁和全球经济一体化的发展,犯罪也呈现出明显的国际化趋势。面对这种新的形势,为保护人类共享的国际共同利益,保护本国的安全和利益,必须加强国家间的司法合作。国际司法合作作为打击犯罪、追缴犯罪所得的重要手段,也受到了越来越多的重视。但是我国对这方面的研究还相对比较薄弱,我们有必要对这一领域进行更广泛、深入的研究。本文在阐述了追缴、犯罪所得、国际司法合作中犯罪所得的含义的基础上,介绍了我国国际司法合作的成果与存在问题,对我国在追缴犯罪所得的国际司法合作中遇到的主要法律问题进行归纳和分析,同时就完善我国的相关法律制度,更好地进行国际司法合作提出了自己的设想和建议。希望通过此文能引起广大学者对这一问题的关注,对我国追缴犯罪所得的国际司法合作广泛、顺利地开展起到一定的积极作用。更多还原

【Abstract】 With the development of international intercourse and globalization, the international relationship has taken a great change, which has lead to the international trend in the criminal area. This trend is going on in two forms: first, the traditional domestic crimes are expanding abroad; second, the crimes that is not limited in one country and the traditional international crimes is increasing obviously. In this situation, the internationalism and transnational trend of crime have disabled the partial regulation in only one country. To protect the common interests of international society and native safety and interests, every country should enhance the judicial corporation with other countries. As a way of crashing down the crimes and pursuing the criminal earnings, international judicial corporation has aroused the attention of more and more countries.In the area of researching on the international judicial corporation, the Europe developed countries have always led the way. Although in Asia there is not such a legal corporation mechanism as in the Europe, the judicial corporation has also got the recognition in many Asian countries. Along with the development of the reform and openness in China, our intercourse with other countries has increased substantially, which leads to the increase of many kinds of crimes, such as the crime of corruption and bribe, the crime of organizational and transnational finance and etc. In this situation, our government is enhancing the protection for the people from these crimes.
