【摘要】 绿色壁垒是指为保护人类健康、保障生态安全和促进自然资源的合理利用而采取的,客观上对国际贸易产生某种限制作用的具有双重属性的贸易壁垒,它的兴起原因复杂,表现形式繁多。随着国际上绿色壁垒制度的不断完善以及发展中国家经济水平的不断提高,绿色壁垒必将成为任何国家保护本国市场和国内环境的合法武器,并对21世纪的中国贸易产生重大、深远的影响。我国已经有了一系列的绿色保护措施,但还不完善。我们必须全面了解WTO框架下的绿色壁垒及其发展趋势,尽快拿出自己的法律对策,使我国的绿色壁垒制度与国际接轨。据此,本文通过实证分析法和价值分析法,从绿色壁垒的形成原因、发展现状入手,对WTO框架下的环境政策与绿色壁垒加以分析,研究WTO成员的绿色壁垒措施对我国的影响以及我国的绿色壁垒措施,提出相应的法律对策。更多还原

【Abstract】 Green bastion refers to the trade barricade which works as a double attribute in restricting international trade in order to guard people’s health, guarantee the zoological safety and promote the utilization of natural resources in reason. While the international society advocating ecological civilization and enforcing the strategy of sustainable development today,green bastion conforms the tide of social development..And a reasonable, standardized green bastion is surely to exist legally for a long time. China has set up a series of green protection bastion policies. However, they are far from perfect. Based on comprehensive understanding of green bastion in the frame of WTO and its trade of development, it is essential for Chinese trade as well as environmental safety to break the trade barricades set by the developed countries, and build up and perfect the green protection of our own. Thus, this specific paper makes an analysis on the causes of the form of the green bastion and the present condition of it as well as the environmental policy and green bastion in the frame of WTO. And the corresponding countermeasures are proposed according to the study on effects of meassures of green bastion by WTO members on China and the measures of green bastion in China.Based on this, the paper is composed of three parts:In chapter one, we make a summary of the concept of green bastion. The first section is on the meaning of green bastion and the limits of the concept, expounding the double attribute of green bastion and evaluating its values. Green bastion is the trade barricade with double attributes. On the one hand, green bastion belongs to the category of non-tariff barricade. It takes strict environmental and ecological standards as the principle connotation, refusing to import the goods or services that are not meet the standards of importing countries. On the other hand, it is different from the traditional non-tariff barricade, functioning as protection of the ecological environment of various countries and even the globe as well as human health.
