【摘要】 随着人类社会生产、科技及经济的不断进步与发展，生产力水平大大提高，与此同时环境问题也日益严重，迫使许多国家强化对严重危害生态环境的行为推行“犯罪化”和“刑罚化”，中国也不例外。尽管中国是一个发展中国家，但中国政府一直比较重视环境保护工作，并采取了有力措施应对环境问题，其中运用刑法手段保护环境就是重要的一环。本文拟从环境保护刑事法律责任的概念及其特征出发，进而中西对比，探讨如何完善我国环境保护刑事法律责任，以促进我国社会的可持续发展。 环境保护刑事责任如何完善，包括诸多方面因素。本文首先从环境保护刑事法律责任概念着手，简单阐述刑法介入环境保护的必然性及我国现行刑法对环境保护的不足。其次分析了环境保护刑事法律发展的理论基础与实践基础，以及这些理论基础对环境保护刑事法律的回应。再次列举比较典型的英、美、德、日等四个国家的环境保护刑事立法模式，并将其与我国进行对比。在我国现有环境保护刑事立法的基础上，借鉴这些发达国家的一些成功经验。最后笔者对如何从理论、制度和实践方面完善我国环境保护刑事法律，提出了建议。并试图从刑法价值取向、环境犯罪构成理论等多方面探讨完善环境保护刑事法律责任，减少环境犯罪，使刑法对环境的保护走上一条行之有效的道路。更多还原

【Abstract】 With the development in production, technology and economy, and the advance in human capabilities, environmental problems are getting more serious, which has forced many countries to strengthen criminalization and penalization against environmental hazards, including China. Although China is a developing country, Chinese government is always attaching importance to environmental protection, and it has taken effective measures to cope with environmental problems, of which protecting environments by criminal laws is an important part. This paper is to introduce and apply the concepts and characters of criminal responsibilities of environmental protection, to compare China and western countries, and to study the improvement of environmental criminal responsibilities in China, for Chinese socioeconomic sustainable development.There are many factors about the improvement of environmental criminal responsibilities. First, by the concept environmental criminal responsibility, this paper explains the necessity of protecting environments by criminal laws, and introduces the inadequacy in Chinese criminal laws for environmental protection. Second, this paper discusses the theoretical and practical bases of the development in environmental criminal laws, and the correspondence between the theoretical base and environmental criminal laws. Third, this paper compares the modes of environmental criminal legislation in China with those in U.K., U.S., Germany and Japan. It also displays the references to those developed countries’ legislation. Finally, this paper offers some suggestions on the improvement of Chinese environmental criminal laws in accordance with theories, institutions and practice. As well, it suggests that it be a good way to improve environmental criminal responsibilities based on the value orientation of criminal laws, theories of environmental crime constitution, etc.更多还原
