【摘要】 1923年,在中国华洋赈灾总会的提倡下,我国第一个农村信用合作社在河北省香河县成立,从此拉开了中国农村信用合作社在农村社会舞台活跃的序幕。农村信用合作社是农村市场主体的新兴力量,也是统筹城乡经济社会发展,建立和谐社会的重要组织载体。它在解决我国“三农”难题方面发挥着独特的作用。但是,由于农村信用合作社自身制度的不健全以及权利分配的不清晰,近几年来,其发展遭遇巨大挫折,许多农村信用合作社濒临倒闭的局面,而且,存续下来的农村信用合作社也并不能起到为农民提供农业资金的作用,农村信用合作社的互助功能可以说大打折扣,进而有很多人对农村信用合作社的存在提出质疑。这种质疑自然有合理之处,但是农村信用合作社如今的发展局势只能说明它自身存在问题,而不应该动摇其作为农村金融组织服务“三农”的基础地位。 本文通过对我国现行企业法人、机关法人、社会团体法人和事业单位法人分类的整合,提出营利法人、非营利法人、社会团体法人和捐助法人的分类,进而明确我国农村信用合作社的非营利法人的地位。针对目前我国农村信用合作社产权不清的状态,在引入财产权框架的基础上,提出了我国农村信用合作社的财产权利归属,国家和社员集体不能作为农村信用合作社的财产权主体,农村信用合作社作为独立的非营利法人对其财产享有财产权,而社员享有广泛的社员权,并且在权利的背后有法人治理结构提供制度支持。在本文的最后,笔者借助我国制定《民法典》的大好契机提出要在民法典中规定我国农村信用合作社的法人地位和财产权,并且还应该制定专门的《农民合作经济组织法》来对农村信用合作社的法人地位与财产权加以明确规定。更多还原

【Abstract】 Countryside credit association is a new emerging force. It is an important organization carrier of helping develop economy and society of town and countryside, building harmonious society. It has an especial effect on settling San nong puzzle in our country. In the last few years, it has encountered a lot of frustration because of its unhealthy system and misty distribution of rights. Many countryside credit associations are close to bankrupt, moreover, left countryside credit associations can’t provide necessary fund, interdependent function weakening, so many persons bring oppugning to countryside credit association. The oppugning is reasonable to a certain extent. But countryside credit association nowadays implies that it has puzzles itself, but its status as countryside financial organization in the service of San nong.This article brings adscription of property right on the base of corporate entity of countryside credit association. Countryside credit association takes property right and members take broad rights basing on their status. Furthermore, countryside credit association must have healthy regulation structure. Finally, penman advises putting corporate entity and property rights of countryside credit association into civil code of our country. Moreover, special law of peasant cooperative economic organization should be constituted.更多还原
