【摘要】 随着社会和经济的发展,环境问题日趋严峻,环境管理部门在依赖传统环境行政行为进行环境保护的同时,也在努力探索新型的环境行政行为和行政措施,环境行政奖励以其优良的品质和独特的个性而倍受环境管理者的青睐,新型的环境行政奖励形式不断涌现,并表现出其对环境保护的杰出贡献。但是无论是环境立法还是环境保护的实践中,环境行政奖励都没有形成一套完整的理论和具体的规定,使得环境行政奖励处于一种理论缺失和实施混乱之中。本文从分析传统环境行政行为及其局限性入手,逐步探讨了环境行政奖励的成因及其价值取向,并结合环境行政奖励的实践,努力探索和构建我国的环境行政奖励制度。主要内容结构为: 一、缺乏奖励机制的传统环境行政。该部分首先环境问题的产生与环境行政的必要性,着重分析了传统环境行政的局限性,从而为环境行政奖励的产生作了理论铺垫。 二、环境行政奖励之成因及其价值取向。本部分着重从非强制性行政的伴生物、可持续发展理论的制度结晶、现代环境行政的应有之义三个方面进行阐述,并进一步探讨分析了环境行政奖励的价值取向,为环境行政奖励产生和存在的正当性提供了理论依据。 三、我国环境行政奖励实践及其缺失。本部分主要分析了我国环境行政中环境行政奖励的立法和应用实践,并对其实践缺失进行了具体分析。 四、环境行政奖励的制度建构及其创新。本部分从理论实践出发,探讨了环境行政奖励实施的基本要求,为我国现行政环境行政奖励实施提出了程序规制,并进一步分析了其具体的救济措施。更多还原

【Abstract】 With the development of the society and economy, the environmental issue is becoming very serious. In the process of the environmental administration, the departments of the environmental administration depends on the traditional means to protect the environment, and at the same time they are still searching for the new types of measures and administrative means. The environmental administration encouragement which comes with its excellent traits and its unique individualities becomes popular to the governors of the environmental administration, and the new-style means of the environmental administration comes forth and plays very important role in the process of the environmental administration. Yet both on the environmental legislation and in the process of the execution of the environmental law, not any an integrate theory has been formed and not any material regulation to guide the practice, and so the environmental administration encouragement actually has been in a chaos. This article is aimed to analyze the limitation of the traditional environmental administration means and to probe into the cause of formation and the value of the environmental administration encouragement , and to adapt to the practice of the environmental administration encouragement, so that try to search for and construct the system of the environmental administration encouragement.The main contents and framework are:Chapter 1 of this article is about traditional administrative means. This chapter begins with the environmental problems and the need of the environmental administration and comes to an analysis of the limited of the traditional environmental administration. On the basis of this, this chapter further conducts the production of the environmental administration encouragement.The chapter 2 is about the cause of the formation and the tropism ofthe valuation of the environmental administration encouragement. In order to offer the theory basis to the formation and the justness of the, this chapter mainly sets forth that the environmental administration encouragement is the contribution and the partner of the sustainable development and the modern and non-compulsory administration.The chapter 3 is about the scarcity of the practice of the environmental administration encouragement. This chapter mainly analyzes the legislation and the practice of the environmental administration encouragement and essentially sets forth the scarcity of the practice of the.The chapter 4 is about the construction and the innovation about the system of the environmental administration encouragement.
