【摘要】 环境保护是我国的一项基本国策,它的开展不仅需要技术、管理等各方面工作的协调,更需要运用法律手段对其进行规范。危险废物污染环境防治是我国环境保护工作中的一项重要内容。我国对危险废物的管理已采取了一系列的措施,如全过程管理、许可证制度、转移联单制度等。这些措施在一定程度上加强了对危险废物的管理,但在立法方面,我国关于危险废物管理的法律制度与发达国家相比还存在很大的差距。当前,危险废物污染造成的污染事故屡有发生,危害严重而且难以消除,笔者希冀通过撰写此文,能为我国危险废物管理的立法提出可行性建议。 论文阐述了危险废物及其管理的基本理论,及我国对危险废物的管理现状和加强危险废物立法的意义,并介绍了国际上和部分发达国家危险废物管理的先进经验,同时,通过对比分析我国危险废物管理的立法现状,指出了其中存在的问题,如:立法层次不高、地方立法不平衡、立法内容的可操作性不强、法律责任不完善等。针对这些问题,笔者提出了一系列的解决对策,建议提高立法层次,增强法律的可操作性,完善并强化法律责任,借鉴国外一些行之有效的管理制度,并提出了制定《危险废物污染环境防治法》的立法设想。更多还原

【Abstract】 Environmental protection is a basic national policy in China. To finish this task not only needs technology, administration, but also needs the measure of law to regulate the work. Preventing hazardous wastes pollute environment is an important content of environmental protection. We had some measures to strengthen the administration of hazardous wastes, e.g. the whole procedure controlling, permitting license system and transferring table system and so on. But in the aspect of legislation, we have a big gap to the developed countries. Environmental pollution accidents usually happen because of the hazardous wastes, its harm serious and hardly to obviate. The author hopes this essay can offer feasible suggestion to the legislation of hazardous wastes in China.This paper elaborates the basic theories of hazardous wastes, crystallizes the concept, character and the harm of hazardous wastes, it expounds the administration situation of hazardous wastes and the meaning of strengthening the hazardous wastes legislation and introduces the advanced experiences abroad. At the same time, the author analyzes the legislation of hazardous wastes in China, and points out the problems etc.This paper lays a lot of proposals to solve those problems, forexample, it suggests promote the level of legislation of hazardous wastes, strengthens the practical of law, perfect the law responsibilities and learn the advanced systems from abroad, the author also introduces to lay down the Law of Preventing Hazardous Wastes Pollute Environment.更多还原
