【摘要】 “依法治国,建设社会主义法治国家”已为我国宪法所确认,而建设法治国家的核心和关键是建设法治政府。文章以政治学、法理学、行政法学的视角,从基本概念入手,分析了我国法治政府的若干理论与实践问题。全文共分四部分。第一部分介绍了法治政府的一般理论,首先阐述了法治与法制、法治与人治的区别,随后分析了法治政府的涵义、基本特征和构成要素。第二部分对新中国法治政府建设进行了历史回顾和现状考察,着重指出了当前法治政府建设存在的问题,并对存在问题的成因进行了分析。第三部分剖析了当前我们国家为什么要加强法治政府建设。第四部分是全文的重点,该部分从转变政府职能、深化行政管理体制改革,建立健全科学民主决策机制,完善行政法制、推进制度建设,强化行政执法,整合政府解决纠纷机制,加强对行政权力的监督和制约,不断提高公务员依法行政的能力七个方面深入探讨了建设法治政府的路径。更多还原

【Abstract】 "Running the country by law and building a socialist rule-by-law state" is already affirmed by China’s constitution and the key to building a rule-by-law state is to build a rule-by-law government .This paper starts with some basic concepts to analyze some theoretical and practical problems of China’s rule-by-law government from the angles of politics、 jurisprudence and administrative jurisprudence. This paper consists of four parts. Part one servers as an introduction to the basic theory of the rule-by-law government. It first elaborates on the differences between "ruling by law" and "legal system", and the differences between "ruling by law" and "ruling by men". Then it makes an analysis of the connotation of the rule-by-law government, its basic characteristics and its essential factors. Part two looks back to the history of the construction of New China’ rule-by-law government, and makes a survey of its present situation, and points out the problem of the present construction of the rule-by-law government, and analyses its resulting factors. Part three tells us why China must strengthen the construction of its the rule-by-law government. Part four is the key part. It thoroughly discusses the approaches to building a rule-by-law government, covering the following seven aspects: transforming the function of the government and further reforming the administration system;setting up and improving the scientific and democratic mechanism of decision making;improving the legal system of administration;intensifying the administrative enforcement of law;integrating the governmental mechanism of dispute resolving;strengthening the supervision and restriction on the exercise of the administrative power;constantly promoting the civil servant’s ability to administer by law.更多还原
