【摘要】 本文从数字信息资源使用的理论与实践角度,对比其他数字信息资源使用方式,阐述了数字信息资源版权许可使用的理论前提与普遍适用性,对数字信息资源的版权属性作了阐释;本文论述了集成数字信息产品和单一数字作品两种数字信息资源许可使用的现状和存在的问题;文章构造了许可使用的流程图,论述了有关数字信息资源版权许可使用协议与许可使用谈判等实践操作问题。全文共分五章。第一章和第二章注重理论的阐述,对数字信息资源及其版权许可使用的概念、特点、类型以及版权许可使用的普适性进行了分析;对数字信息资源的版权认定与归属、许可使用的主体与客体作了较深入的剖析。第三章和第四章将数字信息资源划分成集成数字信息产品和单一数字作品,阐述了国内外集成数字信息产品的集团许可使用的发展现状及存在的问题;同时对单一数字作品的集体许可使用进行了较全面的论述。第五章构造了数字信息资源版权许可使用流程图,明确定位了许可使用各利益集团的角色,阐述了数字信息资源版权许可使用谈判所涉及的策略及许可协议的形式与内容。更多还原

【Abstract】 From the theoretical and practical angle, this article systematically analyses the universalfeasibility 、copyright attribute of the licensing use of the digital information resources andrelevant problems;This article emphatically elaborates the employing condition and existedproblems of two kinds of the digital information resources: integrated digital informationproduct and single digital works. In addition to these, this article formed the flow chart andexpounds the licensing negotiation and licensing contract of the digital information resources.The article comprises five chapters: The chapter one and two emphasizes theoreticalexpositions, analyses the conception、character、types and relative advantage of the copyrightlicensing use of the digital information resources, discusses the copyright digital informationresources recognition & ascription, analyses deeply the subjects and objects of the licensinguse of the digital information resources. The chapter three and four formulated the copyrightlicensing use according to the integrated digital information product and the single digitalworks. The article details the status quo and existed problems of the digital informationresources group-licensing trade and collective licensing use, a few of typical cases areinvolved of. The fifth chapter firstly formed the flow chart , clearly located the role of variousinterests groups, expounded strategies of licensing use negotiation, and the form & content oflicensing use.更多还原
