【摘要】 中药是目前我国在国际上占有优势的少数学科领域之一,但由于不会用知识产权相关法律来保护自己,目前中国本土中药在国际中药市场中所占的份额已经微乎其微,仅占5%左右。而与此形成鲜明对比的是,“洋中药”大肆进入中国市场,对我国中药产业的持续发展带来重大影响。不仅国外公司利用知识产权手段抢滩中国市场,而且国内的中药知识产权也正在以惊人的速度流失,使得我国本土中药痛失市场先机,教训沉痛。目前,国内中药领域不仅知识产权保护意识淡薄,而且由于我国的中药保护形式本身也存在着重大的缺陷,因而面临着巨大的挑战。此外,中药的知识产权保护体系还很不完善。对此,如何保持我国中药知识产权优势,并将传统优势转化为现实的市场优势,是当前需要解决的迫切问题,加强中药知识产权的保护成为当务之急。 本文从中药产业的发展状况出发,分为五章阐述了中药知识产权的保护问题。首先对目前我国中药知识产权保护的现状进行了总结,指出了当前人们对中药知识产权保护认识的误区,接下来主要从专利保护、商标保护、行政保护、著作权保护、商业秘密保护五个主要方面对我国中药知识产权保护的现状进行了深入分析,找出中药知识产权保护落后的原因。继而阐明了中药知识产权保护未来发展的趋势及保护的意义。在此基础上,提出从战略高度研究中药知识产权的保护问题,并系统阐述了中药知识产权保护的对策、策略以及完善我国中药保护体系的建议。更多还原

【Abstract】 Though still one of the few areas in which China nowadays enjoys a dominant position in the international academic circle, because of lack of protection by way of pratice of intellectual property right laws, domestically produced Chinese traditional medicines share as little as about 5% of the international Chinese traditional medicine market. In sharp contrast imported Chinese traditional medicines stream into the market and exert a great negative impact on the development of Chinese traditional medicine industry. Foreign companies try to grab the market by way of infringe of intellectual property right. Still worse, domestic intellectual property right get lost in a frighening speed and result in a heaby loss of the market share, which constitutes a great warning. Nowadays, domestic enterprises are not fully aware of the intellectual property right. The intellectual property right protection for Chinese traditional medicines is not far from being perfect. So it is extremely urgent for us to strengthen our dominant position and change the techniqual advantage into market advantage. And utmost important of all is the strengthening of intellectual property right protection.Starting from the present condition of our development of the Chinese traditional medicine, this paper elaborates on the intellectual property right protection for Chinese traditional medicine in five chapters. First, it summaries the present condition of the intellectual property right protection for Chinese traditionalmedicine and points out the misunderstanding. Then, it makes an in-depth analysis from patent protection, brand protection, administrative protection, copyright protection and trade secret protection and find out about the cause of the problem. Further, it point out the trend of the intellectual property right protection for Chinese traditional medicine and the significance of the protection. Finally, it suggests the study of the intellectual property right protection for Chinese traditional medicine from strategic level and puts forward systematically suggestions for the counter-measures, strategies and the perfection of the intellectual property right protection for Chinese traditional medicine.更多还原
