【摘要】 法律调整机制是对各种法律手段的整体的、动态的理解和把握,其在人类社会不同的发展模式下存在着显著的差异。循环经济是促进社会、经济与生态环保协调统一的“三赢”经济发展模式。研究循环经济法律调整机制有利于从整体的、动态的角度系统地理解和把握调整循环经济的各种法律手段,指导循环经济立法。循环经济发展模式要求根本改变污染物“点源控制”与末端处理的环保策略,以减量化、再利用、资源化为原则,实现经济发展与环境保护的统一。与此发展模式及环境保护策略的转变相适应,法律调整机制也必须做出变革。而从利益衡平角度对循环经济模式下社会资源的配置方式和各种社会主体之间的利益关系进行系统性分析,则是循环经济法律调整机制建立与完善的基础。在循环经济发展过程中,应结合政府、市场、社会等各方面的力量,综合运用强制性、指导性、经济刺激和公众参与等各种不同的法律手段,对经济利益与环境利益的关系进行系统调整,逐步形成规范而有序的法律调整机制,并使之有效运行。更多还原

【Abstract】 The mechanism of legal regulation is to study the law system from the angle of the whole and the dynamic state, under the different development mode of mankind, the mechanism of legal regulation exists to show the difference. The circular economy is new "three win" economic development mode which promotes the unite of society, economy and environment, to study the mechanism of legal regulation of circular economy is advantageous to grasp and comprehend various law measures and to guide legislation of circular economy. Under the mode of circular economy, the environmental protection strategy is Reduce, Reuse and Recycle, producing to carry on the whole process control to the business enterprise, carrying out a prevention of the pollutant source, basically changing the order control and the end processing. Went with this change of the development mode and the environmental protection strategy, the mechanism of legal regulation also needs to change. And install the system analysis towards the arrange way of social resource and the benefit relation of social part under the mode of circular economy, which is the foundations of establishment and perfection of the mechanism of legal regulation. In the process of developing circular economy, should combine the power of government, market and social, adjust various benefit relations about economic development, utilize various law measures of the compulsory administration, the administration guide, the economic stimulation and the public participance, build up the standard mechanism of legal regulation.更多还原
