【摘要】 公民权利,是民主国家中永恒的话题,保障公民权利,是任何一个国家政府都不可推卸的责任。随着民主进程的发展,保障公民权利的呼声越来越高,本文正是在民主社会繁荣发展的背景之下,以城市规划领域为平台,来开展城市规划工作中公民权利的保障研究。本文首先通过对公民与国家、权力与权利两组概念的对比解析,阐明了国家权力的真正来源,公民权利存在的意义,进而强调了保障公民权利研究的必要性。其次,文章简要叙述了现代城市规划对公民权利保障研究的进展,并对比了英美两国城市规划公民权利保障相关制度,通过现代城市规划理论的进展来阐释现代城市规划的本质,通过国外相关工作的经验来强调在我国该研究的重要性。再次,文章在分析宪法和相关法律对公民权利分类的基础上,针对城市规划行为的特殊性,对公民权利做出了有目的性的特殊分类,将公民权利分为物质权利、精神—物质权利和精神权利三类,阐述了该种分类的意义、目的和分类标准,并将城市规划工作中需要保障的公民权利内容具体化; 最后,在分析整合的基础上,建立了一套城市规划工作的公民权利保障制度。在保障机制中,设计了立法机关、行政机关、司法机关的公民权利保障系统; 提供了以公民个人和公民社会为主的两条保障途径; 策划了积极保障和救济保障的保障制度; 并分析了目前《城市规划法》以及相关法律、法规存在的问题,有针对性地提出了具体保障措施。城市规划工作中的公民权利保障机制是规划领域中研究较少的一个课题,其研究、发展以及实施均是一个逐步探索、循序渐进的过程。但需要明确的是,城市规划工作中公民权利的保障是城市规划工作者应该重视的一项内容,只有在城市规划这项政府公共政策、行政行为中充分认识公民权利的重要性,切实从公民利益出发,城市规划才能最终成为一项有利于国家建设、社会发展的有效的行政行为。更多还原

【Abstract】 Citizen’s right is an eternal topic in the democratic state; and safeguarding citizen’s right, is any national government’s bounden responsibility. With the development of democratic process, it is higher and higher to safeguard the voice of citizen’s right. Under the background of the social prosperity and development of democracy, regarding urban planning field as the platform, this text is to promote the research of safeguarding citizen’s right in the urban planning. At first, through analyzing the citizen and country , rights and power comparison with two groups of concepts, this text has expounded the real source of state power, the meaning of citizen’s right existing, and then emphasis on the necessity of safeguarding citizen’s right. Secondly, this article has narrated briefly the progress to the citizen’s right safeguard being studied of the modern urban planning,and compare relevant mechanism of citizen’s right safeguarding in urban planning between America and England. And then explain the essence of the modern urban planning through the progress of the modern urban planning theory, emphasis the importance of this study in our country through the experience of foreign relevant work. Moreover, the article is on the basis of analyzing that classifies citizen’s right in the constitution and relevant laws, to the particularity of the urban planning behavior, has made the purposive special classification to citizen’s right, divided citizen’s right into material right , spirit-material right and spiritual rights, has explained this kind of categorized meaning , purpose and criteria for classification, and has specified the citizen’s right content needing safeguard in city planning. Finally, on the basis of analyzing and combining, this text sets up a series of citizen’s right safeguard mechanism of urban planning. In security mechanism, has designed the citizen’s right safeguard systems: legislature scheme, administrative scheme, judicial scheme and has offered two ways of citizen individual and civil society as safeguarding. It has planned to ensure the system of actively safeguard and relieve safeguard and analyzed the problem at present, that existing in the relevant laws and regulations especially in the “the law in urban planning”, and proposed safeguarding the measure concretely pointedly. The citizen’s right safeguard mechanism in urban planning is to plan to study less subjects in the field, its studies, develops and implements is an exploring progressive. But need a clear one, the safeguard of citizen’s right is a content that urban planners should pay attention in urban planning, fully realize the importance of citizen’s right in this public policy and administrative behavior of government in the urban planning, proceed from citizen’s interests conscientiously, urban planning will become one favorable and effective administrative behavior of social development to national construction finally.更多还原
