【摘要】 本文基于以下观点立论:任何一种舆论形式都是一柄“双刃剑”,会产生或正面或负面的影响;而网络舆论是一柄以科学技术为载体的舆论双刃剑。以此观点为切入点,本文认为:为了理性运用网络舆论这柄双刃剑,必须使网络舆论的表达自由权利既获得足够的保障,也得到应有的限制。而由于网络技术的特殊属性,此种对于表达自由权利的保障及限制又具有不同于其他舆论形式的特点。 首先,本文从舆论主体的去中心化、舆论客体的泛政治化及舆论过程的社会扁平化等三个方面分析,得出结论:网络舆论的表达自由权利可以而且正在得到一定程度的保障。网络舆论有助于政治文明的实现。 其次,本文又从舆论主体的限制性、舆论客体的过滤选择性、舆论过程的非理性和网络霸权的存在等四个方面分析,得出结论:网络舆论的表达自由必将而且正在受到或人为的、或技术的、或文化的因素的限制,这些制约因素虽然在某种程度上是必须的,但却现实地限制了网络舆论对于社会政治生活产生作用的广度和深度。 再次,本文从宏观上构建了一个坐标系,以舆论三要素(主体、客体及过程)为横坐标,以传统大众媒体的舆论形态为纵坐标。在此坐标系中,分析网络舆论的表达自由及其限制与传统舆论形态的相同点与不同点。 通过以上三方面的分析,本文最后总结认为:网络舆论的表达自由权利是实现政治文明的一项重要而有效的工具。能否运用好这项工具,关键在于如果实现保障与限制的辩证统一。只有在保障的前提下限制,在限制的过程中保障,二者才能真正得到有机的统一,网络舆论也才有可能真正促进政治文明的发展进程。更多还原

【Abstract】 This dissertation gives conclusions on the basic point that: any forms of public opinion are double-edged swords; while the public opinion on Internet is a double-edged sword with the science & technology its medium. This dissertation argues that: in order to use this double-edged sword reasonably, we must make the express freedom of public opinion on Internet obtain enough guarantee and receive due restriction. Because of the characteristic of Network, this guarantee and restriction of express freedom is different from other forms of public opinion with its unique characteristic.First, from three respects (the decentralization of the subject, the politicalization of the object and the society-flatten of the course of public opinion) this dissertation concludes that: the express freedom of the public opinion on Internet may be and is being protected, which is of value to the political civilization.Second, from three respects (the restriction of the subject, the filtering-choice of the object and unreasonalization of the course of the public opinion) this dissertation also concludes that: the express freedom of the public opinion must be and is being restricted by some factors.Third, this dissertation constructs a coordinate axis, with the three factors of public opinion (the subject, the object and the course) its X-axis and the forms of traditional media public opinion its Y-axis. With this coordinate axis, the dissertation analyses the common and different characteristic between the traditional media public opinion and the public opinion on Internet.At last, this dissertation believes that the express freedom of public opinion is an important and necessary tool to realize the political civilization. Only when the guarantee and the restriction of the express freedom of public opinion can be combined organically, the public opinion on Internet may promote the process of the political civilization.更多还原
