【摘要】 专利一般例外是各国专利法的重要组成部分,其主要目的在于平衡专利持有人私人利益与第三方利益。各国对各种一般例外大都分别予以规定,但TRIPS协议的协调没有采取此种逐一方式,相反,TRIPS协议第30条采取了总括式规定,设定了各国规定和实施这些一般例外的总的原则和要求。第30条的用语十分模糊,极易引起争议。有鉴于此,本文拟对第30条进行系统研究。 本文分为四章,约10万字。 第一章探讨TRIPS协议第30条的一般问题。该章首先简要介绍了专利权权利限制的几个基本问题,接着探讨了第30条的内容、特点、作用、立法模式与由来,最后阐明TRIPS协议第30条的理论基础。 第二章探讨TRIPS协议第30条的具体解释和适用问题。该章首先阐明TRIPS协议第27条第1款非歧视规则适用于第30条及其适用限制。其次就第30条的具体解释进行讨论,涉及第30条的翻译及解释方法、第30条若干重要词语的解释等。 第三章讨论了几类主要的专利一般例外,包括先用权例外、实验使用例外、伯勒例外、权利穷竭和平行进口例外以及权利滥用例外,就每一例外从理论依据、立法与司法实践概况等方面进行了考察。该章还简单介绍了临时过境、处方准备、非营利目的的使用、善意使用等一般例外。 第四章首先分析了TRIPS协议对发展中国家的影响,其次介绍了我国专利法的修改情况,并提出一些有关专利一般例外的对策。更多还原

【Abstract】 General exceptions of patent are important part of patent law which intended mainly to balance the private interests of the patent-holder and interests of the third parties. Countries in the world provide these exceptions respectively, but the harmonization by TRIPS agreement did not adopt this one by one manner. In return, article 30 of TRIPS agreement adopted a general method, setting out the principles and requirements in providing and enforcing these general exceptions of the WTO members. The language in article 30 is very ambiguous and caused many disputes. In view of the above considerations, this paper studies article 30 of TRIPS agreement systematically.This paper is divided into four parts, including 10,000 words or so.The first chapter examines some basic problems of article 30 of TRIPS agreement. Firstly, this chapter briefly introduces some knowledge of rights limitation of patent rights. Secondly the contents, characters, functions and models of legislation of article 30 will be explored. Finally, this chapter sheds some lights on the rationales of article 30.The specific interpretation and application of article 30 of TRIPS agreement will be taken into consideration in the third chapter. This chapter firstly demonstrates that the non-discrimination rule in article 27.1 of TRIPS agreement should apply to article 30 and its application has some limitations. Then the detail interpretation of article 30 is examined, including the translation and method of interpretation of article 30 and interpretation of some important words in article 30.The third chapter discusses several main general exceptions of patent, including prior use exception, experimental use exception, Bolar exception, rights exhaustion and parallel imports exception, rights abuse exception. The rationales, practices of legislation and jurisprudence concerning these exceptions will be examined in this chapter. In addition, this chapter briefly introduces exceptions of temporarily enteringone country, preparations of prescriptions, uses of none-beneficial purpose, innocent infringement.The fourth chapter firstly analyses the implications of TRIPS agreement on developing countries, then introduces the amendments of patent law in China and puts forward some countermeasures concerning the general exceptions of patent.更多还原
