【摘要】 人类社会是一个不断从低级向高级发展的历史进程,建立平等互助、协调的和谐社会,一直是人类的美好追求。构建社会主义和谐社会的提出,有着特定的时代背景,深厚的理论渊源和丰富的时代内涵。 随着现代法治文明的发展,个人人格得以确立,社会中的公民意识,包括自由意识,平等意识和主权意识日益健全,处于社会全面转型时期的中国社会的和谐,应该是在国家权力与公民权利互动状态下形成的“和谐”。这种具有中国特点的和谐社会,应该是一个公民社会而又超越于一般公民社会的社会;是一个以公正和正义为维度的利益均衡的社会;最终必然是一个“良法善治”的法治社会。社会和谐的建构真正依赖的还是对法律正义的信仰。当法律成为信仰,社会才能在一个共同规则中和谐运转。透析现代法治国家的内在构造和社会主义和谐社会的内涵和时代特征,二者之间有着多方面和深层次的契合。基于这些契合,通向社会主义和谐社会的法治之路的构筑,要求有一个健全的公民意识和一个体现民主、平等、高效、以人为本、诚信、公开、公平、公正、责任等法治理念的法治政府。只有建立在和谐社会之上的法治国家才能真正彰显法治的价值,同时也只有建立起真正的法治文明国家才能最终走向一个公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处的社会,一个多元互动、合作互助、理性人本的社会主义和谐社会。更多还原

【Abstract】 The mankind society is the historical process which developed from the low stage to the advanced stage from time to time. It is the perfect pursuit of human beings for building the harmonious society that’s equal, fair and justice constantly, with the special era’s background, deep theoretical origin and rich times’ inherent content, we put forward the constructing the socialist harmonious society.With the development of modern legal civilizations, individual’s personality has been established and citizen’s consciousness, including the consciousness of liberty equality and sovereignty in society, has been formed fully little by little, so "the harmony" in China should be the harmony which is formed under the conditions of the intercommunion relation of power of state and rights of citizen at the time of the social all-round transformations. With the characteristics of Chinese society, the socialist harmonious society should be not only a civil society but transcend the civil society in common language; should be a proportionality society with the dimensions of social justice and fairness; should be a "well governing by good law" society ruled of law. The constructing of harmonious society depends on the faith of the legal justice. Only when the law is in faith, the society will proceed successfully by means of the common rules. Reflecting the inside formation of modern law-governed state, and the basic conception and characteristics of the socialist harmonious society, we can find there is the multi-aspect and deep-level organic accord. Based on these connections, the building of the path of ruling of law to the socialist harmonious society, needs a healthy citizen’s consciousness and a government under the rule of law with the ideas of democracy equality efficiency opening fairness person-based justice and responsibility. Only founded on the harmonious society, can the state ruled by law really embody the value of ruling of law; at the same time, only by means of building a true state ruled by law, can we realize a fair and justice, faithful and friendly, active, stable and order society;a plural interaction, helping each other and rational society; then a socialist harmonious society within which the human rights is equal to the public power.更多还原
