【摘要】 煤矿安全是现代煤矿企业管理的重要方面,历来是世界各国政府极为关注的一个问题,我国煤矿伤亡事故每年约6500人左右,位居整个工商企业生产安全事故的首位,而煤矿企业作为能源工业的重要组成部分在现代经济生活中发挥着重要的作用。伴随着中国经济的快速发展,国内煤矿工业面临的煤矿安全风险越来越大,越来越难以预测和控制。特别是近年来连续出现特大矿难,在经历多次矿难危机的冲击后,人们对煤矿风险和煤矿安全监察和监管的认识越加深刻。 国家煤矿安全监察局作为中国煤矿行业的监察监管机构,承担着全国煤矿安全行业监察监管的重任,其监察监管职能主要依靠分布在全国的分支机构来完成。然而,由于新监察监管体系建立时间较短(大约5年时间)、理论研究滞后等诸多原因,基层煤矿安全监察机构在有效行使监察监管职能方面还存在着许多问题和障碍。如何改善和加强煤矿安全监察监管工作,有效的实施煤矿安全监察,有效的防范和化解煤矿安全风险已成为煤矿企业发展亟待解决的重大问题。 本文以兰州煤矿安全监察分局辖区的煤矿安全监察监管为研究背景,以提高煤矿监察监管的有效性为研究的核心问题,依据调研资料,对兰州煤矿安全监察分局煤矿安全的监察、监管进行了系统的研究。首先论述了国家煤矿安全监察的历史演进过程,对现行的监察监管体系进行了深刻的剖析,从而找出目前监察监管体系所存在的问题和缺陷。如没有形成系统、规范和连续性的监察监管目标、尚未将煤矿法人治理结构的内部控制作为监察监管重心、监察手段单一、存在个人和组织阻碍,管理幅度不大,监察监管队伍综合业务素质有待提高、严肃性有待加强、地方、乡镇煤矿存在政府管理不规范、企业行为不规范、缺乏政策支持、屡发重特大事故原因多、信息保障可靠度低等问题,在此基础上,对煤矿安全有效监察监管体系的目标、监察监管主体、监察监管客体、煤矿安全监察监管行为、有效监察监管的外部约束、更多还原

【Abstract】 The important aspect that the coal mine safety is the modern coal mine business enterprise management, is a problem that the international community government extremely pays attention to in times gone by, the our country coal mine dead and injured trouble are or so about 6500 people annually, reside the whole industry and business enterprise to produce the safe trouble first, but the coal mine business enterprise is the importance of the whole industry business enterprise and the energy industry to constitute the part to develop in modern deconomy live incomparable core function.Accompany with the fast development of the Chinese economy, the safe risk of coal mine that local coal mine industry face is more and more big, more and harder estimate and control. Appear continuously in recent years especially the big mineral is difficult, after experience many impacts of crisis with difficult mineral, the people deepen to engrave to the coal mine risk and the coal mine understanding of safety inspect and take charge offs more.The national coal mine safety inspects the conduct and actions Chinese coal mine profession of the bureau to inspect to take charge of the organization, the heavy responsibility that undertake the safe profession of national coal mine to inspect to take charge of, it inspects to take charge of the working talent to mainly depend on to distribute the branch organization in whole country to complete.
