【摘要】 专家证人制度是英美法系国家证据制度的重要组成部分,它是伴随着科学的发展和技术的进步而产生的,并满足了逐渐增多的现代型诉讼纠纷的需要。专家证人以证人的身份参与诉讼,它仅能对案件中的事实部分发表意见,而对案件中的法律问题,则由法官依据职权予以适用。专家证人制度有着丰富的内涵,从主体到程序运行都有一套具体制度和规则予以规范。它的一系列具体制度和规范都是在整个英美法系大的法律文化背景下设计和运行的,与其相配套的各种制度和措施也都是植根于英美法系法律传统的。 大陆法系国家的鉴定人制度与英美法系国家的专家证人制度在诉讼中承担的功能基本相似,都是为了解决案件中涉及专业性知识的事实认定问题。本文通过对专家证人和鉴定人的诉讼地位、资格、选任、权利与义务和民事责任等几个方面的比较,目的在于揭示专家证人制度的优点和弊端,以及如何吸收专家证人制度的合理成份,继而改进和完善我国的鉴定人制度。本文认为我国完善鉴定人制度最现实的做法是,通过扩大鉴定的内涵,在同我国其他制度不相抵触的前提下,合理借鉴专家证人制度,对我国的鉴定人制度予以充实和改造,使之达到理想状态。更多还原

【Abstract】 System of expert witness is an integral part of system of legal evidence for countries with Anglo-American law system. It came to into being with the development and progress of science and technology, meeting the increasing need of modern criminal proceedings disputes.The expert witness participates in the lawsuit in the capacity of witness. He can only present his opinion on the implementation of the legal case, while it is the judge who according to his function and power applies the law to the legal questions in a case.System of expert witness has abundant connotations with series of concrete systems and regulations from subject to the operation of proceeding.All of its concrete systems and norms are designed and run in the legal culture background of Anglo-American law system; and various kinds of systems and measures matching it are also rooted in the legal tradition of Anglo-American law system.In countries of continental law system the surveyor system basically bears similar function with the expert witness system in the lawsuit. Both aim to address the problem of identifying the fact in the legal case concerning professional knowledgeTherefore, this text, by comparison between the expert witness and the surveyor in such aspects as their status, qualification, selection and appointment, right and obligation and civil liability in the litigation etc., aims to find out the advantages and disadvantages of system of expert witness, and the way to draw on the rational component of it so as to improve and perfect the system of surveyor of our country.更多还原
