【摘要】 随着全球畜牧业的迅速发展,我国现行的兽药管理法律体系存在的不足和缺陷日益突出,且与一些发达国家差距明显;以致不能很好的控制有关兽药的质量、不合理使用、违法行为、兽药残留以及由残留导致的国际贸易争端等问题。为此,加强我国兽药管理,完善我国的兽药管理法律体系已显得尤为重要和迫切。鉴于学习和借鉴国外发达国家兽药管理的成功经验是加速我国兽药管理体制建设的捷径之一,本文提出对美国和加拿大两个国家的兽药管理制度进行研究,旨在借鉴美、加两国先进的兽药管理模式和方法,完善我国兽药管理的法律法规建设;促进我国兽药行政管理的法制化、科学化、系统化和现代化;加速我国在兽药产业的全面发展,提升我国兽药产品在国际上的地位:以及更好地保护动物性食品消费者的合法权益,促进公众健康和社会发展。 本研究应用了历史研究法、描述研究法和比较研究法阐述了美国兽药管理法规的历史演变过程;阐述、比较了美、加两国的兽药管理法律体系。全文内容包括美国和加拿大兽药管理制度两大部分。首先,分别从美、加两国兽药管理的法律体系、管理机构、管理内容以及兽药残留与食品安全四个方面予以论述。法规方面,总结了美、加两国现行的所有有关兽药的法规、规章以及条例等,并在内容上做了简单说明。同时论述了美国兽药管理法规的发展演变过程;机构方面,总结了两国参与兽药管理的政府管理机构,且对相应机构的职责、组成等做了概括性说明;内容方面,就法规规定的有关兽药的审批与注册、生产、经营、使用、进出口、标签与说明书、监督等要求做了概括性描述:兽药残留与食品安全方面,总结了美、加两国在兽药残留控制方面所从事的相关活动,同时概括提出两国各自的食品安全管理体系。然后,对美、加两的兽药管理情况做了一概括性的比较分析。最后,在整体论述的基础上,为加强我国兽药管理,完善兽药管理体制与法律体系提出了一些理论更多还原

【Abstract】 With the rapidly development of stockbreeding in the whole world, law system of the veterinary drugs gradually emerges its limitation, and it obviously drops behind the developed countries. Thus, we can’t adequate control some problems, such as the quality, the illogical use and the illegal action on veterinary drugs, the veterinary drug residues, and the international trade hindrances, and so on. Therefore, it is important and instant to enhance the administration of veterinary drugs, and to perfect construction of the system of the veterinary drug laws and regulations. In virtue of it is a short cut to study the experience that is advanced and successful from developed country and use for reference, this thesis put forwards to study the administrative system of veterinary drugs in the United States and Canada, for the purpose of drawing on the advanced models and methods on veterinary drug administration on the both of counties, perfecting our law construction of veterinary drug administration, and making the administrative agencies of veterinary drugs legitimization, science, systematization, and modernization, accelerating the comprehensive development of veterinary drug industries in China, advancing the position of veterinary drug production in the international trade, protecting consumer of the animal food and promoting the public health and the society development.The ways of the study are the historical research, the descriptive research, and the comparative research, and the contents of the thesis are two sections, both of the United States’ and Canadian regulations on veterinary drugs. Firstly, the thesis espectively describes law system, administrative agencies’ and contents on the veterinary drugs, veterinary drug residues and food safety in the United States and Canada, includingdescription of the evolutive history of veterinary drug laws in the United States. Then, the thesis provides a general comparation, proposes suggestions and imagination, so as to provide the evidence for improving China’s veterinary drug laws and regulations.Based on the research, the thesis comes to a conclusion that there are many resemblances between the United States and the Canada. They similarly succeed in approval and register on new veterinary drugs, the surveillance on marked productions, the establishment and amendment on the criterions and regulations, the scientific research and the enforced implement or correcting the mistake. Likewise, there is a great emphasis on the administration on the veterinary drug residues and food safety for both of countries. In a word, there are many advanced experiences from the United States and the Canada worthy our study, for improving our law system of veterinary drugs.更多还原
