【摘要】 1932年3月1日伪满政权成立,日伪为了使之更具有“独立”国家之形,连续颁布了一系列的法令。但是惟独没有制定伪满洲国的“国籍法”,对于建立现代国家重要法律之一的“国籍法”始终未定,其中的原因是很复杂的。 一方面,“国籍法”的制定不像其他法律的制定那样简单,例如对伪满洲国的“国民”的界定问题,即伪满洲国所谓的3000万“国民”究竟是指哪些民族?如何用法律的观点去衡量?则不得其解。若是按照《建国宣言》里对享有“新国家”平等待遇的民族作“国民”的定义标准是不妥的。因为这本是宣言“五族共和”、“机会均等”、“平等待遇”,并不是为本国“国民”所下的定义,更不能以其作为法律上的依据,因此就为伪满“国籍法”的制定问题埋下了伏笔。 另一方面是最重要也是最令日伪感到为难的是,居住在东北的日本人和朝鲜人双重国籍的问题处理,这是很棘手的。居住在东北的日本人均可拥有“满洲国”的国籍,但是日本人在感情上并没有脱离日本国籍而加入“满洲国”国籍之意,这就增加了日本人双重国籍的产生;尤其是1936年7月所谓的《日满条约》和其附属说明中更是表明了日本人是以不脱离本国国籍为前提的,其结果更是增加了在满日本人双重国籍情况的产生。对于东北朝鲜人由于历史上的种种原因以及1929年修改的《中国国籍法》也在无形之中增加了在满朝鲜人双重国籍情况的产生。日帝担心,若不恰如其分地解决伪满洲国“国籍”问题,在人们的印象当中的伪满洲国只不过是日本人的傀儡政权,在国际社会上也会受到谴责。 正因为如此以及日本一直忙于东亚战争而无暇顾及处于难产中的伪满洲国“国籍法”,即使出现了许多的“国籍法草案”,但是直至1945年统治者还未制定正式的伪满洲国“国籍法”;同时“暂行民籍法”却在无形中替代了难产中的更多还原

【Abstract】 At the Janpanese aggressors’ bayonet point , the "Manchoukuo" puppet Regime came out in march 1,1932. And it issued a series of "decress" to maintain its rule. However, Janpanese aggressors and their puppet regime failured the "Nationality Law" of "Manchoukuo", the cause of thing is very difficulity. On the hand ,it is not easy to do it such as other commom Law .For example ,how to different "Manchoukuo’s nationlity" from other regime’s national. In other words what’s meaning of "Manchoukuo" puppet Regime called 3,000 millions national? How to comprension these called "Manchoukuo’s nationlity" in Law point ? Surely, in its Establish Country Declaration interpreted this new country’s national were people who enjoyed equality rights ,However these interpret were not definition about "Manchoukuo" puppet Regime national.and it only assert "nations equality"and "changce equality",So its answer is not advsible and it made some hidden troubles to draft "Manchoukuo" puppet Regime Nationality Law.At the same time also was a hard nut for Janpanese aggressors and their puppet regime to crack was the "dual nationality" of those Janpanese and Koreans residing in Northest China then,but their "Nationality Law’Vas very thorny. Those Janpanese immigrants resiading in Northest China did not gain "Manchoukuo’s nationlity" in affection throught deprived Janpanese Nationality. Especially whenJuly ,1936 called Japan And Manchoukuo Peace Treaty’s Postscipt,add the posipolity of "dual nationaliy.To Koreans residing in Northest China, they also had dual nationality because of some history things and China Nationality Law which was revised in 1929.1f deal with this thorny thing failurely, the Janpan goventment would carried that the people think the " Manchoukuo" only was puppet country.In a word, Janpan aggressors wanted a Nationality Law of "Manchoukuo" according with their ideas, however no matter what ,it is very difficulty ,and it needs some thory to do. At the same time, the Janpanese aggressors were always busy in preparing for The Estemal War,so negected to draft "Manchoukuo’s Nationlity"and lay down. Even if these called "Manchoukuo’s Nationlities" often came out , however true "Manchoukuo’s Nationlity" failed to appear when the Second World War ended in 1945 officially. But the Janpanese immigrants and Koreans residing in Northest China still had "dual nationality",the thorny thing did not was solved surely.更多还原
