【摘要】 合理使用制度作为著作权法利益平衡机制的重要组成部分,在协调创作者、传播者和使用者之间多元利益关系、维护个人利益与社会利益的平衡上发挥了不可代替的作用。但是,这一制度自产生时起就不断受到科学技术的挑战。当前,网络环境的形成极大地影响着著作权制度,数字网络技术对著作权合理使用制度造成了前所未有的挑战。合理使用制度亟待人们检讨与完善。本文从数字信息技术与法律制度两个层面就网络环境中合理使用制度所遭遇的挑战及完善等问题给予以了深入细致的研究。首先,从宏观上介绍了网络环境的形成及其对著作权制度的影响;其次,从技术措施、网络合同、信息网络传播权以及禁止规避技术保护措施等四个维度,对网络环境中合理使用制度所遭遇的挑战予以详细分析,认为它们侵蚀了合理使用制度所具有的利益平衡功能;第三,从法哲学、法经济学、利益平衡原理等方面就网络环境中合理使用制度的继续存在进行了正当性思考;最后,从技术与法律制度的融合以及对新型信息网络传播权利予以适当限制两个方面对网络环境中合理使用制度的完善提出了相应的立法建议。更多还原

【Abstract】 Fair use system is the vital constituent of beneficial balance mechanism of copyright law. It has played an un-replaceable role in coordinating benefits among creators, disseminators, and users, maintains the balance between the personal benefits and public benefits. However, the system received challenges from science and technology since it came into being. Now the formation of Internet environment greatly affected the copyright system. Digital network technology has made an unprecedented challenge to the fair use system. It needs an urgent examination and perfection. From technology of digital information and legal system, this paper gives a thorough and careful research on the challenge and the perfection of the fair use system in Internet environment. Firstly, it introduces the formation of Internet environment and its impaction on copyright system on macroscopic aspect. Secondly, it analyzes the challenges which made to fair use rule in Internet environment from technological measures, and cyberspace contracts and the right of information network dissemination and forbidding circumvention of technological measures etc. aspects. And they infringe the function of balance of interests of fair use rule. Thirdly, the reason and justice of fair use rule in Internet environment is analyzed in terms of legal jurisprudence and legal economics and the principle of balance of interests. At Last, some suggestions of legislation are made in Internet environment from both the together of technology and law system, and the restriction of the right of information Internet dissemination.更多还原
