【摘要】 我国立功制度的产生和发展经历了一个漫长的历史演变过程,其地位在刑法体系中也日渐重要。它是我国刑罚制度的重要组成部分,也是目前常用的一项法律奖励措施,其法律作用不可低估。虽然立功制度正不断走向健全与完善,但依旧存在较多缺陷和瑕疵,理论研究和司法实践过程中的问题也不少,立功制度的课题研究十分必要。我国刑法确立的立功从宽处罚制度符合我国现实国情,是我国惩办与宽大相结合刑事政策的制度化和法律化,体现出刑法的人权保障机能。它对于教育和惩罚犯罪、保护国家和社会的利益、实现刑罚一般预防和特殊预防的目的,具有极其重要的意义。国内许多学者对此进行了广泛的探讨,并取得了一些可喜的研究成果,诚然,这对于最终解决上述矛盾是很有益的。笔者试图联系实际典型的案例,围绕立功和立功制度的基本问题,如立功的概念、本质、特征和类别,立功的成立要件和认定,立功的法律后果,立功制度的历史演进和意义,以及立功制度的立法缺陷与完善等,进行了初步的探究,并提出了自己的一些浅陋见解,期望能够为这一课题的研究贡献绵薄之力。更多还原

【Abstract】 Our nation’s system of meritorious service experienced a long historical production and development course. Its position is important day by day in the criminal law system, too. It is an important component of the system of penalty of our country, and a commonly used measure in legal reward and punishment at present . Though the system of meritorious service is being sound and perfect constantly, still there are many defects and flaws, and there are quite a few problems in theoretical research and administration of justice. The subject of the system is particularly necessary in research. A lot of domestic scholars have carried on extensive and profound discussion to this. This is certainly very beneficial to solve the above-mentioned contradictions finally. Our nation’s system of meritorious service accords with the realistic national conditions. It is legal and institutionalized policy of combining punishment with leniency, and embodies the function of the criminal law to assure the human rights. It is very important to educate and punish crimes protect the interests of country and the people, realize the purpose of general and special prevention of penalty. The author use the typical real case, focus on the basic problems of the system of meritorious service, such as the concept, essence and significance of the system; the concept, essence , characteristic and classification of meritorious service, important elements, assertion and legal consequence and legislative defects of the system and perfection, etc, carry on preliminary probe into it, put forward some meager opinions and hope to contribute the meager strength for the research on this subject sincerely .更多还原
