【摘要】 近现代意义上的国家主权理论自产生以后,便产生了许多争议,其中之一就是国家主权是否可以让渡。在此问题上,在国家主权概念和理论产生的早期,人们一般认为国家主权是不可让渡的,到现在,仍然有许多学者坚持国家主权不可让渡论。然而,随着时代的发展,国家主权可以让渡的新思潮开始出现甚至发展成为当今关于国家主权让渡的主流思潮。如今,在国家主权是否可以让渡问题上,国家主权让渡论者和国家主权不可让渡论者展开了激烈的争论。 国家主权是否可以让渡?国家主权让渡之争为何产生?本文认为,国家主权含有主权身份、主权权威、主权意志、主权利益、主权权力等多种要素,这些不同的要素在是否可以让渡问题上是不一样的,主权身份、主权权威、主权意志等要素是不可让渡的,否则就是失去了国家主权;主权利益、主权权力等要素是可以转让的。在国家主权是否可以让渡争议问题上,不同的学者用国家主权的不同要素来代指国家主权是国家主权让渡之争发生的直接原因,国家主权的多要素内涵是国家主权让渡之争的根源。 在国家主权是否可以让渡问题上,本文认为国家主权是可以部分让渡的,国家主权的部分让渡实际上就是国家主权可让渡要素部分的让渡。国家主权包含可让渡要素是国家主权部分让渡的理论基础。同时,本文认为,国家主权是一个动态的概念、发展着的理论,国家主权在不同的历史背景下有不同的内涵,在当前全球化的时代背景下,国家主权的部分让渡是历史的必然,当前全球化的时代背景是国家主权部分让渡的现实基础。更多还原

【Abstract】 Many debates have been raised since the birth of the theory of state sovereignty. One of the debates is the transferability of it. At the early period of the theory, people usually believe that state sovereignty is un-transferab;e, and there are still many scholars stand this opinion at present. However, with the develop of the times, the new idea tide that the state sovereignty can be transferred has raised and even became the mainstream of the theories on the transferability of state sovereignty. Nowadays, the scholars of the two parties started a fierce debate on the transferability of state sovereignty.Is state sovereignty transferable? Why there is a debate on it? This paper believe that the state sovereignty has many factors like sovereignty identity、 sovereignty authority、 sovereignty will 、 sovereignty profit、 sovereignty power, etc. The transferability of these factors are different, sovereignty identity 、 sovereignty authority and sovereignty will can not be transferred, or is the lose of the state sovereignty; However, sovereignty profit and sovereignty power can be transferred. On the debate of the transferability of the state sovereignty, different scholars use the different factor of the sovereignty to indicate sovereignty is the direct cause of the rise of the debate. The multi-factor content of the sovereignty is the root cause of the debate.On the transferability of the state sovereignty, this paper believe that the state sovereignty can be partial transferred, and the partial transfer of the state sovereignty is actually the transfer of the transferable part of the state sovereignty. That state sovereignty contents transferable factors is the theoretical foundation of the partial transferability of the state sovereignty. This paper also believe that the state sovereignty concept and theory is in developing, the meaning ofstate sovereignty changes with its historical background. At the present background, the partial transfer of state sovereignty is unavoidable. The present historical background of globalization is the practical foundation of the partial transfer of state sovereignty.更多还原
