【摘要】 本研究旨在探讨我国公立中小学校教师权益的法律保护及救济。教师的权利是指教师依法应当享有的各种权益,它是当前我国教育法学领域和法制实践中的一个重要课题。依法保护教师的合法权益对于维护教师的职业尊严和社会声望、明确教师的法律地位、提高教育教学质量促进教育教学改革以及实施科教兴国战略具有重要的理论意义和实践意义。然而,现实生活中,由于法律的不完善造成侵犯教师权利的现象屡屡出现,严重影响了我国依法治国、依法治教的进程。我们理应根据教育立法精神和司法实践,完善教育立法,切实保护好教师的合法权利。 本文主要运用法理分析、文献、比较及案例法,对当前侵犯我国公立中小学校教师权利的各种现象与行为进行了批判性反思和法律分析,从而提出了有效保护教师合法权益的可操作性建议。 研究首先阐述了教师的职业权利和教师作为公民的一般权利及其保护的合法性依据。接着运用法理分析法和案例法对目前侵犯我国公立中小学校教师各种合法权益的现象进行了分析,并指出其背后的原因。最后,在上文分析的基础上,提出从确定教师法定身份,确立与教育行政部门和学校的法律关系、完善教育立法、拓宽教师权利的救济途径、加强监督等几个方面来对教师的权益进行有效的法律保护。更多还原

【Abstract】 The purpose of this research was to probe into the legal protect of teacher’s rights in elementary and secondary public schools in China’s mainland. It is an important topic in theory, research and practice of Chinese educational law. It is important realistic meanings for safeguarding the teacher’s job dignity and social popularity, improving educational teaching quality ,facilitating the reform of education and teaching, implementing the strategy of revitalizing the nation through science and education that we protect the teacher’s legitimate rights in accordance with the law. But the phenomenon of infringing teacher’s rights appears repeatedly because of law perfection in the actual life, It has influenced our country to run the country according to law , to manage the process taught in accordance with the law seriously, we ought to perfect the educational legislation and protect the teacher’s right well conscientiously according to educational legislation spirit and administration of justice.The thesis aims at critically reflection and legal-principle analysis on the phenomenon of infringing teacher’s rights, and points the reasons in it. Based on legal logic, documents, comparision, the author gives us her point of view on how to protect the teachers’ legal rights.The study begins with the teachers’ job rights and general rights as a citizen, and the legitimacy basis of protecting them. Then the article analyzed the factors infringing teacher’s rights. In the final part, the article dealt with the realization of protecting teacher’s rights, providing some legislative and judicatory suggestions about the procedural protection and legal remedies of teacher’s rights.更多还原
