我国特殊教育立法之研究

【摘要】 我国特殊教育立法正处于起步发展阶段,特殊教育法律制度正处于发展和完善的过程中,这是客观的,也是不可逾越的。把特殊教育管理纳入法制化轨道是现代法治社会的必然要求,完备的特殊教育法律制度可使特殊教育管理工作的方方面面都有章可循,使依法治教得到强有力的法律保障。本文通过历史考察方法、文献分析方法、比较分析方法、价值分析方法,以我国特殊教育立法为研究对象,试图概括出当前特殊教育立法存在的主要缺憾及其产生的原因,并尽可能地提出了一些意向性的建议。 本文共分四个部分,其基本框架和主要内容如下: 第一部分从对特殊教育立法的界定入手,介绍了我国近现代特殊教育立法的概况并分别进行了评述。 第二部分论述了我国特殊教育立法发展的历史必然性,分析了我国新时期特殊教育立法的特征和功能。 第三部分论述了我国现行特殊教育立法和特殊教育法律规范存在的缺憾。并就社会对特殊教育认识不足,特殊教育立法的思想观念淡化:国家教育经济资源不足影响特殊教育立法的发展;我国的特殊教育立法组织形式、程序不尽合理等方面分析了产生缺憾的主要原因。 第四部分提出了我国必须把现代特殊教育思想引入特殊教育立法;确立平等、倾斜保护的特殊敦育立法原则;完善我国特殊教育法律体系;努力实现我国特殊教育立法的法治化、民主化、科学化等建议。
【Abstract】 The special education lawmaking of our country is being placed in the start development stage, the special education law system is being placed in the development and in the perfect process, this is objective, also can’t exceed. Bring into the special education management legalizes the orbit is the inevitable request of the society of modern rule of law, the complete and special education law system can make special education management the square aspect of the work face all there is chapter can follow, make cure by law to teach to get the powerful law guarantee. This text passes the history investigation method, the cultural heritage analysis method, more analytical method, worth analytical method, taking special education lawmaking of our country as the research object, trying to generalize at present special educate the main missing of the lawmaking existence and the reason that it produce, and put forward some intention suggestions possibly.This text is total to is divided into four part, its basic frame and main contents as follows:The first part from commence to the define of the special education lawmaking, introduce the near modern and special education of our country the general situation of the lawmaking combines to carried on to say the respectively.The second part discussed the our country special education lawmaking the history of the development is inevitability, analyzing our country current special education lawmaking of the characteristic and the function.The third part discussed the missing of the our country current special education lawmaking and the law norm of education. Combine society to special educate , the thought idea of the special education lawmaking downplay-, the nation educates the development that the economic resources shortage affects the special education lawmaking; the special education lawmaking organized form, procedure of the our country does not fulfill main reason that reasonable etc. analyzes to produce the missing.The four part cent our country must lead the thought of modern special education e into the special education lawmaking; The establishment is equal and tilts to one side the protective and special education lawmaking principle; Set up the special education law system ;Hard special education of our country of realization lawmaking of rule of law turn, democratization, scientific etc. suggestion.
