【摘要】 招标投标作为一项新生事物,随着在我国建设领域内的逐渐推行,正发挥着越来越积极的作用,特别是2000年《中华人民共和国招标投标法》的正式施行,标志着我国国家投资建设工程招标投标已取得了实质性的成绩,为国家节约了大量的建设投资。但在推行中仍然存在不少问题,主要表现在:地区发展不平衡;政出多门,管理混乱;对招标工作监督缺乏有效性;政企不分,以招代管,行政干预不同程度地存在,在某些行业或地区还比较严重;工程建设招投标活动中存在“职权腐败”现象;将依法必须进行招标的项目化整为零或者以其他方式规避招标、虚假招标;不按照法定程序开标、评标和定标;施工企业为了中标,以低于成本价进行恶性竞争的现象愈演愈烈;普遍存在工程招标投标中的不正当竞争行为(也称串通招标行为)等。 本研究首先介绍了招标投标的基本概念、起源和主要方式,同时具体阐述了建设工程招标投标的发展情况、现状及特点,以及我国招标投标制度的立法情况。重点就我国国家投资建设工程招标投标过程中的程序管理及案例进行了分析,通过对招标投标过程中的一些违法违规行为的介绍,并结合招标投标程序管理的要求进行了具体的阐述。最后,提出有针对性的建议:遵循政企分开原则,积极推行代理业主制,实行投资、建设、运营管理“三分离”的项目管理体制;建立健全招标代理机构市场准入和退出制度,推动组建招标投标协会,实行行业自律;在工程量清单计价模式下加速建立起完善、科学、合理、可持续发展的施工企业定额;积极推行设定预算控制价作为最高限价的无标底招标和合理低价中标;加强评标专家队伍建设,进一步完善专家评审制度,提高评更多还原
