【摘要】 知识产品的平行进口问题是与国际贸易相关的一个知识产权问题。在我国加入WTO以后,各国贸易消除了关税壁垒的情况下,知识产权产品平行进口已成为各国为了维护本国经济利益而设置的另一种贸易壁垒,所以对其研究已成为热点问题。著作权产品的平行进口就是在某一著作权产品受到一国著作权法保护的情况下,进口商未经授权将著作权人或经著作权人许可在国外制造、销售的该产品进口到该国的行为。 对于知识产权产品的平行进口问题研究,国内外学者主要集中在商标和专利产品领域,对著作权产品的平行进口问题讨论较少,在我国相关立法上亦是空白。 如同其它的知识产权产品的国际贸易一样,版权贸易的迅速发展,也使得著作权的平行进口,成为各国为了维护自身的利益而采取的贸易壁垒之一。 在著作权领域内,对待平行进口的态度正是各国利益平衡后的结果。笔者认为我国在著作权平行进口问题上不应该采取绝对禁止或绝对允许的“一刀切”的态度,而应该在立法上确定和补充相关的理论基础,借鉴各国的司法实践,从本国利益出发,对平行进口问题加以规定。 随着我国加入世界贸易组织,版权贸易亦随之增加,平行进口问题会日渐突出,积极的解决这个问题,具有迫切的现实意义。另一方面,我国对这一问题还没有很好的解决途径,因此,本文对著作权领域内平行进口的问题进行了全面的梳理,为我国解决著作权平行进口纠纷,提供一些理论上的参考和建议。 本文由三章构成: 第一章将阐述著作权平行进口的一些基本理论问题,作为后文论述之基石。本章主要论述的问题有三:一是对国内外有关平行进口的概念进行比较分析,并在此基础上提出自己的理解和定义。二是对著作权平行进口的概念和特征进更多还原

【Abstract】 The intellectual property goods of parallel import is an intellectual property issue related with international trades .After China entered into WTO and the trade barriers of goods between countries have been eliminated, parallel import of intellectual property goods become another trade barriers to maintain national economic interests for counties. So is also becomes a topic of general interest. Copyright goods of parallel import is defined as that when a copyright good is protected by a domestic copyright law and import businessmen are not authorized the rights that product , sell and import goods to the country by copyright man or authorized man.To study on parallel import of intellectual property goods, most of scholars focus on the domains of trade marks and patents, but few on copyright, and our legislation are blank.The quick development of copyright trades, as well as other international trades of intellectual property goods, parallel import becomes another barrier of goods trades to maintain domestic economic interests for countries.In the domain of copyright, the attitude to parallel import is the results of balance of interests for every country. In our Copyright Law , we can’t take absolute measures on the issue of parallel import .We should define and supplement relative theories ,use the judicial experience of other countries for reference and regulate of parallel import in our legation from benefits of our country.On one hand, As China has entered into WTO and copyright trade has been increased, the issue of parallel import is gradually outstanding. So it’s realistic meaningful to solve the issue. On the other hand, in our country, we don’t have goodmethod to solve this problem. So this article is to straighten out parallel import of copyright overall and support some theoretical suggestions and reference to solve problems of copyright parallel import.This article concludes three chapters:Chapter one is to discuss basic issues of copyright parallel import as the foundation of this article. This chapter concludes three parts. First part is to compare conception of parallel import between at home and abroad. Second part is to discuss conception and characteristics of copyright parallel import, as a result of author’s own understandings of copyright parallel import. Last part is to analyze three theories which can support or oppose parallel import and found out the basic theories of copyright parallel import.Chapter two is to analyze copyright works and copy from compatriotic law and use three theories which are put award in first chapter. This chapter concludes three parts. First part is to study appearing causes of copyright parallel import and make sure different beneficial driving causes. From the attitude of nature of copyright, second part is to combine some international representative experiences and cases which oppose or support copyright parallel import and analyze difference and causes of copyright works and copy of parallel import abroad.Chapter three concludes two parts. First part is to discuss legal existing situations and causes of copyright parallel import. Second part is to discuss the legal solutions of domestic Copyright Law.更多还原
