【摘要】 金融期货起源于二十世纪七十年代的美国。二十多年来,无论是在发达国家,还是在发展中国家,金融期货都得到了迅猛发展。但近几年来,在全球发生了既有涉及地方政府投资基金破产的美国加州奥兰治县事件,又有震撼全球的老牌英国投资银行巴林银行倒闭事件,更有涉及东南亚数国金融市场面临体系崩溃的亚洲金融风暴。这一连串的金融危机和风波都与风靡全球的金融期货有关。于是,各国在发展金融期货的同时,又建立和完善了金融期货市场的法律制度,在一定程度上,保证了金融期货市场的健康发展。 2001年我国加入WTO后,为了更好地发展我国的经济,顺应世界经济的发展潮流,在加强金融监管的基础上,逐步开展金融期货交易。然而,我国现行的金融期货理论仍停留在介绍金融期货市场的一般性知识或一些基本概念的层次上,没有对金融期货市场进行深刻的研究。而且在是否发展我国的金融期货市场方面和发展的可行性方面以及如何发展等方面,在学者之间也存在很多争论;在实践中,我国金融期货市场也出现了一系列的风波事件,而且在这一系列事件背后,无不与我国尚未建立完善的法律制度有关。为此,如何建立和完善我国的金融期货市场法律制度,就成为现阶段的主要任务。 本文内容主要分为四个部分。 第一部分为我国金融期货市场概述,阐述了金融期货市场的基本知识,并对我国的金融期货市场作了一个大体的介绍;第二部分阐述了我国金融期货市场法律规范的现状及缺陷;第三部分阐述了国外金融期货市场发达国家的法律规范;第四部分为全文的重点部分,在借鉴西方金融期货市场法律制度经验的基础上,结合我国实际,提出了一些适合我国国情的,关于建立和完善我国金融期货市场法律制度的对策。 笔者力图运用比较分析、理论联系实际等研究方法,从法律的视角对我国金融期货市场法律制度进行审视和探讨,以求促进我国金融期货市场法律制度规则的进一步科学化,规范化。更多还原

【Abstract】 Financial Futures originated from American in 1970’s. About twenty years, financial futures developed speedily in developed countries and developing countries. But recently, happened lots of financial crisis and financial storm. All financial calamities were related to financial futures. So many countries established and perfected the law system of financial futures when they developed the financial futures. To a great extent, assuring the health development of the financial future market.After our country joined in the WTO in 2001, in order to develop our country economy, and comply with the world economy development trend, in the base of strengthen financial regulation, our country developed financial futures business step by step. But our country currently in effect financial futures theories only stay with the stage of introduction financial futures market common concept and knowledge, the deeply research of financial futures market wasn’t involved, and in the fact of whether or not developing financial futures market in our country and how to develop our country financial futures market existed mangy arguments. In practice, our country financial futures market appeared many disturbance incidences. Because our country didn’t develop perfectly the law system of financial futures, appearing mangy disturbance. So how to establish and perfect our country the law system of financial futures market was the main assignment nowadays.The thesis includes mainly four charters:The first charter was the general narrate of the financial futures market of china, introduce the fundamental knowledge about the financial futures market, and introduce the financial futures market of china. The second charter analyzed the present situation of the law system of the financial futures market of china and defect. The third charter researched the law system of the financial futures market in developed countries districts including American, Japan and Hong Kong district in China. The fourth charter was the focal point, in the base of draw lessons from the foreign experience, and combined our country reality circumstances, we gave to some the way to deal with a situation,更多还原
