【摘要】 不动产登记制度作为一项重要的物权法制度,在物权法体系中具有重要的地位。关于不动产登记制度的学术文章近年来数目繁多,学术观点纷繁复杂、各有千秋。这从一个侧面说明了我国目前法学的繁荣,也在某种程度上反映出我国在该方面的理论还远未成熟,至今还没有形成一个比较统一的看法与理论构架。我国在不动产登记制度方面的理论研究与实践探索仍任重而道远。在我国正在进行民法典与物权法制定工作的今天,对不动产登记这一重要的物权法基本制度进行充分研究与论证,具有现实的理论意义与重要的实践价值。　本文以为,要弄清不动产登记涉及的诸多理论问题、进行科学合理的不动产登记制度设计,应该从分析不动产登记的历史演变过程入手,认真检视不动产登记法律制度中的一些根本性问题,比较、分析现行理论界的诸多学说,统一对某些重要理论问题的基本看法。只有在以上的理论基础上,我们才能依此检讨目前我国不动产登记制度的理论不足与制度缺陷,为今后的制度设计与完善描绘出较为清晰的轮廓与脉络。更多还原

【Abstract】 As　a　basic　system　of　the　property　law,　the　legal　system　of　registration　for　real　estate　rights　is　vital　to　the　property　law　system.　Today,　since　our　country　is　making　the　civil　code　and　the　property　law,　researching　on　the　registration　system　of　real　estate　rights　has　realistic　theory　meaning　and　practice　value.　In　my　opinion,　in　order　to　make　clear　the　theory　problems　relating　to　the　registration　system　of　real　estate　rights,　we　should　begin　from　analyzing　its　history　process,　and　then　examine　some　basic　theory　problems　in　the　field.　Based　on　the　above　theory,　we　can　review　the　present　system　of　our　country,　finding　out　its　advantages　and　disadvantages,　and　furthermore　give　some　constructive　advices　of　legislation　and　system　designing.　This　paper　includes　three　parts.　The　first　part　of　the　paper　deals　with　the　involving　core　concepts　and　some　related　theory　problems.　The　main　concepts　include　the　real　estate,　the　real　estate　rights,　the　registration　of　real　estate　rights　and　etc.　The　important　theory　problems　are　about　the　social　functions　of　the　registration　system　of　real　estate　rights,　the　nature　of　the　registration　and　its　legal　consequences.　The　second　part　focuses　on　our　country’s　condition,　pointing　out　the　shortage　of　the　present　system　after　serious　analysis.　The　third　part　puts　forward　some　lawmaking　suggestion　and　system　speculation.　The　registration　for　the　real　estate　rights,　the　author　thinks,　is　a　kind　of　judicatory,　burdening　the　social　duties　of　protection　for　the　private　rights,　macro　controlling　of　the　nation　and　other　social　services.　The　registration　system　of　real　estate　rights　is　vital　to　the　private,　the　country　and　the　society　as　a　whole.　Many　shortages　exist　in　the　present　registration　system　in　our　country　exist,　but　the　most　urgent　problem　is　the　integration　of　registration　organization.　This　paper　thinks　that　our　country　should　establish　a　independent　registration　bureau　at　each　county　district　and　bringing　it　into　the　judicial　system.　The　personnel　of　each　registration　bureau　should　be　looked　as　a　part　of　the　community　of　law　occupation.　Only　by　this,　can　we　realize　the　specialization　of　the　registration　organizations　and　the　identity　of　the　registration　personnel,　and　realize　the　system　optimization　afterward.更多还原
