【摘要】 21 世纪也许是女性全面追求性解放的时代,但妇女的性权利作为基本的人权,在法律中却若隐若显。本文从四个方面对妇女的性权利进行了法律的、历史的和现实的追寻,从而揭示了妇女性权利缺失的法律原因、历史原因及社会文化原因。性别平等是实现妇女性权利的基本前提,但为什么性别平等在公共领域的法律文本确立后的今天,因为性别歧视妇女的性权利仍然时常遭到来自公共领域和私人领域的贬损和惩罚?本文从性别歧视的法律起源入手,通过对私人领域的性权利、婚外性行为、婚内强迫性行为以及婚姻基础的分析,得出如果简单赋予女性与男性平等的法律规定,并不能从根本上消除性别歧视,保护妇女的性权利。本文对妇女性权利的法律追寻并没有全面展开,而选择了一些特殊的侵权方式,对女性的性屈从进行了独特解构与说理。第一,从人类学、社会学的角度,揭示了性权利的起源及这一起源的法律建构。第二,从性别平等的角度揭示了性权利与国家权力的关系,从而将妇女性权利的保护与国家公权力介入性的原则及限度联系起来。第三,本文通过对婚内强奸渊源与基础的分析,从传统法律文化对婚内强奸的纵容,厘清了婚内强奸原初之所以为男权法律所遗弃的历史原因,从国际人权保护的法律视角阐述了对妇女性权利保护的基本原则和方法。第四,本文从婚姻的性别特征入手,对传统婚姻的基本结构进行了深入的分析,揭示了传统婚姻背后所隐藏的对妇女的性压迫和性奴役,阐述了新的生育革命给妇女性解放带来的曙光。第五,婚外性行为作为当今社会一种常见的侵权行为,无论从广度上还是从深度上对广大妇女造成的情感伤害比婚内强奸还要深刻,本文从社会现实到法律现实论证了婚外性行为的危害性,从而提出了对妇女性权利保护的法律依据。本文以辩证唯物主义的认识论为指导,综合运用了比较的方法、法理学的方法和社会学的方法,在前人研究成果的基础上,对妇女性权利的缺失进行了结构性的批判和剖析。重点放在传统公权力所忽视的私人领域的妇女的性权利的缺失上,进一步论证了保护妇女性权利必须对男权法律建构的公共领域和私人领域的结构进行彻底的改革,不仅要改变其划分的标准,还必须消除性别歧视的文化观念,这也充分地表明了对妇女性权利保护的研究有待于深入。更多还原

【Abstract】 In the 21st century ,woman begins to pursue more sexual right liberation. However, woman’s sexual right,---one of the basic human rights, is not so heavily emphasized in the law as women expects.This paper expounds woman’s sexual right at the angle of law and histoiry,and reveals the present situation of the protection of woman`s sexual right, aiming at exposing the reason why woman can not enjoy sexual right fully at the angle of law,history and social culture. Being eqnal in sex is the basic of realizing woman’s sexual right. But nowadays,even though man and woman are announced to be egual in the publiclaw, at many cases,woman’s sexual right is still derogated and punished because of sexual discrimination .Begining with the law of sexual discrimination,this paper explains the sexual right in private sphere,the extramarital sexual affairs,and the compelling sexual affairs in marriage,and the base of marriage,at the end,it makes a conclusion that the announcement of sexual equality in law can not eliminate sexual discrimination and protect woman’s sexual right. This paper doesn’t discuss woman’s sexual right at the angle of law,but chooses some special angles to explore why woman nowadays fails to enjoy sexual right fully. Firstly,at the angle of Anthropology and sociology, it explains the origin of sexual right and its legal frame. Secondly, it explains the relationship between sexual right and nation’s power.at the angle of sexual equality,then it connects the protection of wman’s sexual right and the principles for nation’s public power to involved into law .Thirdly, on the basis of explainning the origin of rape in marriage,and it reveals the historical reason of rape in marriage ,and it also expounds the basic princiales and methods to protect woman’s sexual right at the angle of the law of international human right’s protection .Fourthly, on the basis of sexual characteristics in marriage, it gives a detailed explation of the basis frame of the extramarital marriage,and it tries to reveal that nowadays woman is still oppressed and enslaved in sex in the tradiztional marriage and the policy of new birth liberation’will bring new hope to woman’s sexual liberation Fifthly, since the extramarital sex act---one of the most common . sexnal tort in the modem society , hurts woman’s emotion and dignity much more deeply than the rape in the marriage , then this paper proves the harmfulness of extramarital sexual behaviour at the angle of social reality and law’s reality , and it also puts forward legal proof for protection of woman’s sexual right . Guided by the theory of knowledge in dialectical materialism , using the comparative methods , the methods in law and the methods of sociology , this paper analyzes and criticizes woman’s loss of sexual right on the basis of other’s research results. It emphasizes that it needs to have a more fully reform in the public aspect and personal aspect of woman’s legal frame . and eliminate the cultural idea of sexual discrimination . in order to protect woman’s sexual right . And it also points out that it’s still a long way to go in the research of protection of women’s sexual right.更多还原
