网络环境下版权法律问题研究

【摘要】 网络作为传统媒体之后的第四媒体,以迅雷不及掩耳之势发展,网络信息的传播速度和方式使传统媒体受到巨大挑战,同时,网络作品的传播也对现行的《著作权法》提出了新的挑战——如何界定网络传播权?网络环境下如何实现知识产权制度的利益平衡?以及网络作品的集体管理制度,这些是本文重点关注的问题。 本文共分三个部分 第一部分:信息网络传播权。该部分首先通过论述网络作品的法律地位、构成要件、归类,从而对其进行界定;其次论述了国际社会为了规范作品在互联网上的传播行为而作出种种尝试,从而产生了网络信息传播权;最后,分别以发达国家和我国为例阐述了相关的立法实践。 第二部分:网络版权的限制。该部分的主要观点是:对权利人实行权利限制成为保持权利人、作品传播者与社会公众之间权利平衡的调节器。版权限制的内容有:合理使用、法定许可和强制许可。 第三部分:网络作品的集体管理。该部分首先论述了版权集体管理制度的起源、发展;其次论述了集体管理组织的法律地位;最后提出了在网络环境下实行版权集体管理的构想。更多还原

【Abstract】 As the fourth media after the traditional media, network emerges as sudden as lightning, and the transmitting speed and mode of network information challenges thetraditional media--how to define the network transmission right? How to realizethe interest balance of intellectual property right in network environment? And the collective management system of network productions, all these are the core problems of the paper.My paper can be divided into three parts. The first part is about transmission right of information network. By introducing the legal status, composing factors and classification of networks productions, it defines the network productions. Then it points out the different attempts in order to adjusting the transmitting action of works in network, it in turn produces transmission right of information network. Finally it explains the relevant legislative practice by examples of foreign countries and China.The second is about the network copyright limitation. The main viewpoint is that limiting the rights of the owners is the adjustor between the transmitter of works and the public. The copyright limitation expresses chiefly in such three aspects as reasonable usage, legal permission and coercing permission.The third part is about the collective management system of network productions. It first reveals the origin and development of network productions. Then it points out the legal status of collective management organization. Finally it proposes the plan to carry out the copyright collective management in network environment.更多还原
