【摘要】 石油作为重要的战略性资源,具有重大的经济和政治意义。随着经济的不断发展,带来的是石油资源供求矛盾的不断加剧,在世界各国都为最大限度的占有石油资源而斗争的今天,法律作为调整各种社会关系的有效手段,已经被应用在石油资源领域。本文旨在建立一个适应我国发展要求的石油资源法律体系,使我国宝贵的石油资源在完善的法律规范体系下得以合理的开发利用和保护,进而维护我国的石油安全。 本文从分析世界石油资源现状入手,简要介绍了世界石油资源现状、世界一些先进国家的石油资源立法现状及立法的最新趋势,进而分析我国的石油资源现状,我国石油行业管理及石油立法概况,总结问题所在,提出建立以《石油法》为基础的我国石油资源法律体系的基本构想。 在本文中,如何构建石油资源的法律体系是所要解决的根本问题。在立足于我国现实情况,总结立法中存在问题的基础上,借鉴国外先进立法经验,从纵横两个方面提出了立法建议。从法律体系的纵向来说,选择全行业统一立法模式,建立以《石油法》为基本法律,其他石油专项行政法规、地方性法规、部门规章,以及石油行业的内部管理规范等为补充的,层次清晰明确的石油资源法律体系;从法律制度的横向来说,建立健全包括石油资源产权制度、石油储备制度、石油行业的政府监管制度,以及石油安全预警与应急处理制度等基本法律制度在内的,涵盖石油资源的勘探开发、加工炼制、运输储备,以及油品销售等石油行业各领域的完整系统的法律体系。由此,形成一个纵横交错、制度完备、调整全面,并且能够与我国基本法律体系相协调、相融合,适应我国发展需要的石油资源法律体系。更多还原

【Abstract】 The petroleum that is regarded as important strategic resources has the great significance of economy and policy with the development of economy. It increasingly aggravated that the supply and demand contradiction of petroleum resources. Recently the trend of countries all over the world is a fight for accopying the petroleum resources maximumly and a law, as a kind of effective means of adjusting social relationships, already has been applied into the field of petroleum resources. The subject of this paper is to establish a thorough petroleum resource law system , which can adapt to development requirement of our country, provide reasonable utilization and protection of our precious oil resource and maintain the safety of our petroleum system.The paper starts from current situation of world petroleum resources and briefly introduces the current legislative situation and latest legislative trend of the world. Then it analyzes the current petroleum resources of our country as well as the management and legislative situation in petroleum industry. Finally, it concludes the existing problems and proposes the fundamental ideas for our country’s oil resource law system.The essential problem to be solved in this paper is how to construct the petroleum resource law system. Basing on the current situation of our country, summing up the existing problems in the legislation, and utilizing the past experience of foreign legislation, we propose the following legislative suggestion in terms of the depth and breadth of the subject. To expand on the depth of the subject, we propose to adopt a uniform legislative mode for the whole field, which establishes the "petroleum law" as the basic law and complements it with other petroleum-specific administrative codes, local codes, departmental regulation, and internal management criterion. To expand on the breadth of the subject, we propose to establish a well-rounded law system which includes a property right system for petroleum resources, a petroleum storage system, a government supervisory system, and a safety early-warning and emergency response system. This system also encompasses the survey and exploration, process and refinement, transportation and storage, sales and distribution of petroleum resource. Through this, a well-organized, synergistic, and complete law system is formed to coordinate and merge with our basic law system.更多还原
