国际刑事法院管辖权问题研究

【摘要】 本文以《罗马规约》所规定的国际刑事法院管辖权为研究对象,通过对其在各方面所涉国际法问题的详细分析,指出国际刑事法院的现行管辖权运作机制符合国际法和国家主权原则,不应成为我国加入《罗马规约》的最大障碍。我国应以更加开放的态度看待国际刑事法院,加强观察、交流与研究,为将来在适当时候加入规约作好准备。 为论述这一问题,文章分为五个部分。第一部分通过对国际刑事管辖权和国际刑事法院的概述,明确本文借以立论的一些基本概念和背景。第二部分以《罗马规约》为蓝本,研究国际刑事法院管辖权所涉及的一些基本问题,包括:国际刑事法院管辖权的效力依据和管辖职能、行使管辖权的先决条件、管辖权效力范围和管辖权的启动机制。第三部分阐述国际刑事法院所管辖的四类国际犯罪,对它们在定义、适用范围或适用条件方面所涉及的争议问题进行了分析,并探讨了法院所管辖国际犯罪的增扩问题。第四部分通过对国际刑事法院管辖权与国家刑事司法主权关系的各种处理模式的分析,指出《罗马规约》所确立的补充性管辖模式兼顾了尊重国家主权与保障法院基本职能之实现,因而是目前处理二者关系的最好选择。第五部分对我国对待国际刑事法院管辖权的立场及其理由进行了反思,认为从法律上讲,国际刑事法院的管辖权问题不应成为我国加入《罗马规约》的障碍,并对我国目前应有的态度和对策提出了几点建议。
【Abstract】 This article studies on the jurisdiction of the ICC. Through analyzing the legal issues it concerned, the article demonstrates that the jurisdiction mechanism of the ICC conforms to rules of public international law and the principle of state sovereignty. Therefore, it is actually not an obstacle to China’s accession to the Rome Statute. China shall take an open attitude to the ICC and do some prepare work for accessing to the Rome Statute in the future.This article contains five parts. Part 1 introduces the power of international criminal jurisdiction and the new international organization: the ICC to provide some basic conception and background for further argument. Part 2 elaborates the basic issues the ICC’s jurisdiction concerned, including the source of its force and its functions, the preconditions to the exercise of jurisdiction, its force scope and the trigger mechanism. Part 3 elaborates the four types of international crimes that fall within the scope of the ICC’s jurisdiction, and discusses the issue of scope extending of the ICC’s jurisdiction. Part 4 demonstrates that the principle of complementarity established by the Rome Statute is the best choice in dealing with the relationship between the ICC’s jurisdiction and national jurisdiction by comparing different types of relationship model, because it not only respects state sovereignty but also keep the ICC working effectively. Part 5 through reviewing China’s position and its reasons on the issue of the ICC’s jurisdiction, demonstrates that the jurisdiction of the ICC is not an obstacle to China’s accession to the Rome Statute, and on this basis, put forward some constructive advises on this issue.
