【摘要】 在知识产权法律制度中,对知识产权的保护是关键和核心环节,是其功能的主要方面。然而,知识产权法律制度设立的宗旨,绝不仅是对权利的保护。知识财产、智力成果从根本上说,应当属于全人类,社会进步就是在智力成果的创造主体们不断互相学习、摹仿的过程中发展的。从此意义上讲,对知识产权的保护也正是为了追求社会公众整体的利益。本文通过对知识产权理论中具有普遍意义的专利权、驰名商标、版权以及在计算机广泛进入公众生活的情况下的网络环境下的版权保护的探讨,试图将我国与其他发达国家进行对应比较,比较研究知识产权侵权理论中侵权行为的构成、侵权行为的类型、侵权责任的归责规则、以及知识产权侵权损害的赔偿等问题,并且结合我国已经加入WTO的现实情况,在阐述国际社会知识产权保护发展趋势的前提下,比较我国在知识产权保护领域内存在的问题和差异,并提出了相关的改进建议,以期对我国的知识产权保护领域有所帮助,并为繁荣我国的知识产权保护事业作出自己的全部努力。更多还原

【Abstract】 Protection of Intellectual Property Rights is the core and fundamental part in intellectual property right law system. However, the principle of establishment of intellectual property rights law system lies not only in protection of rights, In essence, intellectual property and achievements should belong to all human beings. The society develops in the process of learning and imitating by creators of the intellectual achievements. Protection of intellectual property rights is in this sense the pursuit of general public interest. This thesis compares our country with other developed countries in respects of: composition of tort in intellectual property right theory, types of tort, blaming principle of tort, compensation for tort, etc., through the analysis of patent rights, famous brands, copyrights, which are profoundly meaningful in intellectual property right theory; studies copyright protection in network environment with the widespread utilization of computers in daily life; defines problems and differences in intellectual property right protection field and suggest some ways for improvement while stating the trend of intellectual property right protection in international society under the condition that china has entered WTO. The purpose of the thesis is to provide some help to the prosperity of the cause of China’s intellectual property right protection.更多还原
