【摘要】 自1776年亚当·斯密出版《国富论》,经济学脱离哲学成为一门独立的社会学科以来,研究者蔚然成风。而经济理论来自于对人类经济现象的观察和总结,必然随着经济的不断发展而同益创新。不管家庭承包经营制还是现代企业制度,所取得的成功及其所伴随的问题,都是经济学理论所不曾预料到的。中国的改革开放给经济学人士进行理论创新提供了大好的机会。 中国经过20多年的改革,农村社会主义市场经济体制框架初步建立,农户逐渐成为活跃的市场主体,农村土地使用权长期化、资本化、物权化的趋势已基本确定。但在近年农村经济发展过程中,出现了不少侵犯农民利益的问题。这其中隐含着内在因素和外在因素。如:政策、法律法规、社会环境等。因此,本论文从保护农民的利益出发,研究农村土地制度和土地使用权流转问题,具有深刻的现实意义。 论文共分为四大部分:第一部分介绍中国农村土地产权制度和土地使用权流转的内涵以及土地流转的约束机制;第二部分主要介绍中国目前农村土地使用权流转的主要方式、存在问题及分析:第三部分举例介绍土地使用权保障问题的一些海外经验。第四部分提出促进农村土地使用权有序流转的政策性建议:必须完善政府职能,加强政府对农村土地问题的宏观管理;必须建立完更多还原

【Abstract】 Since The Wealth of Nation by Adam Smith was published and the economics broke away from the philosophy, the pursuer had become common practice. And that economic theory was from humanity’s looking-in and summing-up of the economy phenomena. Necessarily it was set up newly along with the development of economy. In spite of the household contract System or modern Corporation System, their making good winning very concomitant problem, was never expected by economic theory. Chinese reformation and opening offered economic scholar with the finer chance for innovation of theory.In that China traversed twenties years reformation, the frame of the rural socialism market economy system was established. The farmer turned into the active market principal part. The trend of the usage right of rural land turning lasting, capitalization and substance powered was confirmed. But during current development of the rural economics, problem of encroaching the farmer’s interest appeared. This latent intrinsic factors and outer factors, such as policy, law, social condition etc. Thereby this paper study problem of rural land system and land use rights on behalf of the protecting the farmer’s benefits. It will possess profound reality meaning.This paper shares four parts. The first one introduced Chinese rural land property system and the meaning of land usage right. The second one mainly introduce the moving mode of Chinese presently rural land usage right.. The third part gives examples of abroad experience on safeguarding the land usage right. The fourth part put forward some advice on promoting the orderly moving of rural land usage right. We must consummate the government function, strengthen the government’s managingof rural land problem. We must establish the perfect market function, enforce the law system on rural land. We must found rural guarantee system and relieve the farmer’s worry.更多还原
