【摘要】 行业协会作为一种社会组织,是公民社会领域的一部分。然而它又不同于其他非营利组织,它直接与经济活动密切相连,按照国家、市场、社会的三分模式,它与市场领域密不可分,在一定意义上,可以认为行业组织是企业组织的延伸。尤其是在中国从计划经济向市场经济的转型过程中,随着政府的“放权”,行业协会作为特殊的中间力量可以有效的弥补市场管制的真空,这对于形成“大社会、小政府”的格局是非常必要的。行业协会性质上的特殊性也决定了它在反倾销过程中必然游刃于政府与企业之间。在处于转型时期中国,行业协会的定位更具有特殊性。它在一定意义上是政府机构改革的产物,从而使中国的行业协会处在国家、社会、市场三方边缘。 本文研究的主要内容大致分为四部分:第一部分研究了行业协会反倾销功能实现的基础,从WTO反倾销制度和行业协会应对反倾销的功能优势两方面,阐述了WTO体制下行业协会功能的扩展空间;第二部分对我国行业协会在应对反倾销方面的现状进行了分析,通过我国行业协会在反倾销的角色和表现分析以及与国外行业协会的比较分析,得出我国行业协会在实现反倾销功能方面存在的问题;第三部分主要研究了影响我国行业协会实现反倾销功能的障碍因素,从企业、行业协会、政府三方面进行了详细分析;第四部分针对制约性因素的分析,提出了相关对策,并结合WTO体制下行业协会的功能优势,提出了建立“三位一体”的反倾销体系,并对政府、行业协会、企业作了合理定位等。更多还原

【Abstract】 As a kind of social organization, trades society is part of people social fields. However it is unlike other nonprofit organizations in that it has a close tie with economic activities. According to the three division mode of nation, market and society, it is indispensable with market realm. In a sense, trades society can be viewed as the extension of enterprises. China is undergoing a transmission from planned economy to market economy. As the government is gradually giving up it "saying power", trades society, as a medium force, can effectively make up the vacuum area in market regulation and administration. The specialty of trades society determines its existence to be one that earns its value between the government and enterprises. In present transforming and ever changing China, the positioning of trades society has a special quality. It can be seen as a product of government agency reform. This requires and forces trades society to live among three parties—the nation, society and market.The main research contents of this thesis consist of four parts. Part one presents the foundation for the realization of trades society’s antidumping function. From the perspective of WTO antidumping system and trades society’s functional advantage in antidumping response, the expansion space of trades society’s function in WTO system is furtherillustrated. In part two, an analysis is made about the current state of trades society’s antidumping response and countermeasures in China. Through the analysis of the role that our country’s trades society plays and the performance it presents, as well as a comparison made between Chinese and overseas trades society, problems that exist in the our country’s trades society antidumping function are concluded. The third part primarily concentrates on the study of the obstacle factors in the way of trades society’s antidumping function realization in our country. From three sectors: the government, trades society and enterprises, an analysis is made in detail. In the last part, based on the analysis of constricting factors, pertinent countermeasures are put forward. While combining trades society’s functional advantage in WTO system, it proposes to establish an antidumping system with the name "three in one system" in the hope of rationally positioning the government, trades society and enterprises.更多还原
