【摘要】 20世纪90年代以来,以计算机及网络技术为核心的信息科学技术迅猛发展,并被广泛应用于社会各领域,给人类社会以深远影响。电子商务是信息科学技术应用于经济领域的创造,是21世纪的新经济模式,由于它具有传统商务所不能比拟的优越性,引起世界各国的高度重视,各国把它作为本国经济发展战略的重要组成部分。与此同时,计算机信息技术这把“双刃剑”也为电子商务领域犯罪创造了条件,在不长的时间内,电子商务领域犯罪迅速发展起来,严重威胁着电子商务的安全,引起了各国刑事立法、司法及理论研究工作者的高度重视。本文就是从犯罪学的角度,研究了目前国内外电子商务领域犯罪的发展态势,了解电子商务领域犯罪的整体特征,然后分析了这类犯罪的犯罪人结构、犯罪客观表现等方面的特征,并试图从犯罪学、社会学的角度分析其产生的原因和条件。关于电子商务领域犯罪的对策,作者认为,要有效地防治电子商务领域犯罪,必须充分考虑电子商务领域犯罪的特点、我国电子商务发展及立法现状,从多方面构建电子商务领域犯罪综合控制体系,包括技术控制、健全管理、完善立法,以及加强公民网络道德和法制教育。更多还原

【Abstract】 With the rapid advance of computer and Internet, the 1990s witnessed increasing applications of information technology in various social fields and its far-reaching impacts on human society. E-commerce, the product of information technology in economic domain, has become a new economic mode in the 21st century. Due to its incomparable superiority over traditional business, e-commerce is attached great importance and plays a significant role in making economic development strategies throughout the world. Meanwhile, this double-edged sword of information technology lays ground for new e-crime, which develops so fast that it puts a serious threat on the security of e-commerce, engaging intense attention in criminal legislation, administration of justice and research workers. From the perspective of criminology, this paper analyzes the tendency of e-commerce crime at home and abroad, trying to explore its overall features. The traits of e-criminals and the nature of e-crime are also discussed in terms of criminology and sociology. Our argument is that to combat e-commerce crime effectively, we should first be acquainted with the e-commerce in China, the basic features of e-crime and our legislation status quo. In response a comprehensive monitoring system is proposed to construct in this paper, including technology control, sound management, improved legislation and enhancement of civil network morals and legal education.更多还原
