【摘要】 二战以后,区域贸易安排迅猛发展,尤其是20世纪80年代以来,区域贸易安排与多边贸易体制的共存与发展成为世界经济领域的基本特征。一方面,WTO的成立与运作推动着经济全球化不断向纵深发展;另一方面,各种类型的区域贸易安排在世界各地蓬勃发展,掀起了区域经济一体化的高潮。多边贸易体制与区域贸易安排的关系是什么?如何正确处理我国与区域贸易安排的关系?我国与区域贸易安排的关系对两岸建立更紧密经贸关系安排有着怎样的启示?这些问题对我国的未来发展有着十分重要的意义。作者正是在这样的国际、国内背景下展开对WTO关于区域贸易安排法律规则的研究。 本文共分五个部分。第一部分:分析了区域贸易安排的内涵、特征及相关理论;第二部分:回顾了区域贸易安排的历史沿革,剖析了区域贸易安排的发展现状,并对世界主要的区域贸易安排进行了介绍及评述;第三部分:对WTO关于区域贸易安排的法律规则,即《关税与贸易总协定》第24条、《关于解释1994年关税与贸易总协定第24条的谅解》、《服务贸易总协定》第5条、1979年东京回合“授权条款”进行了仔细分析与解读。第四部分:深入探讨了区域贸易安排与WTO多边贸易体制的关系,首先对区域贸易安排与多边贸易体制的关系做出了总体评价,然后分析了区域贸易安排对WTO的积极贡献与严峻挑战,提出了两者之间是相辅相成的关系。第五部分:基于前面四个部分的论述,针对我国如何处理与区域贸易安排的关系、两岸该如何建立更紧密经贸关系的问题提出了相关的法律对策与战略举措。更多还原

【Abstract】 After World War Ⅱ, the regional trade arrangements (RTAs) have developed rapidly, the multilateral trade system (MTS) and RTAs’ co-existence and development becomes the essential characteristic in the territory of world economic. On the one hand, WTO’ s establishment and function propels the economic globalization; on the other hand, RTAs’ flourishing sets off the climax of regional economic integration. What’ s the connection between RTAs and MTS? How shall we cope with the relation between China and RTAs? These problems are of great significance to China’ s futural growth. The author starts to research on WTO’ s legal regulations concerning RTAs under such background at home and abroad.This thesis is divided into five parts. Part Ⅰ analyzes the connotation, features and theories related; Part Ⅱ reviews the history of RTAs, analyzes the current situation of RTAs and gives a commentary on main RTAs in the world; Part Ⅲ gives a careful analysis and explanation of WTO’ s legal regulations concerning RTAs, that is GATT1947 Article ⅩⅩⅣ, Understanding on the Interpretation of Article ⅩⅩⅣ of the GATT1994, General Agreement on Trade in Services (GATS) V and Tokyo Round 1979 Enabling Clause; Part Ⅳ Studies the relationship between RTAs and MTS. At first, the paper gives a comprehensive appraisal of them, then discusses the RTAs’ devotion and challenges to MTS, and draws a conclusion that they are supplements and complements each other; Part V, which is aiming at the dealing with the relation between RTAs and China, establishment of closer economic partnership arrangement (CEPA) between Mainland and Taiwan, puts forward legal and strategic countermeasures related.更多还原
