【摘要】 我国已成为世界贸易组织(以下简称WTO)的成员,国际服务贸易应在《服务贸易总协定》(以下简称GATS)的框架下开展。在WTO“服务部门分类表”中,法律服务是服务贸易中商业服务项下的专业服务,其市场开放问题属于GATS的调整范围。本文根据有关国际条约,参照最新研究成果,初步探讨了GATS框架下中国法律服务市场开放问题,力求为规范中国法律服务市场的对外开放提供理论指导与实践依据。 全文共分四章,约三万八千字。第一章阐述了GATS框架下法律服务的概念、范围及方式;第二章分析了法律服务市场开放的主要障碍及法律服务市场的发展趋势;第三章论述了中国法律服务市场开放的承诺、现状及利弊;第四章写在中国法律服务市场开放已成必然趋势的情况下,政府部门担负着维护法律服务业秩序、降低对本国律师之冲击与提供外国律师进入市场的机会之间不断寻求“动态平衡”的重任,需要认真研究应对策略。更多还原

【Abstract】 Our country has entered into WTO successfully, as WTO enclosure of protocol, "the General Agreement on Trade in Services" take legal effect to our country already. As one special commercial service among the service trade in WTO "classification chart of service department", its market matter of opening belong to adjusting range of GATS. On the basis of relevant international treaties, consulted the latest research results, this paper has probed into the matter of opening of service market of Chinese law under GATS frame tentatively, which is of certain theory value and realistic meaning.This text divides into four chapters altogether, and amounts to over 38,000 words. The first chapter is about the concept, classification and ways of legal service. In the second chapter the author analyses the main obstacles of market access which legal service faces and the development trends of the opening of legal service trade. The third chapter is about the promise, current situation, and pros and cons of the opening of Chinese legal service market. And the fourth chapter is about the countermeasures of the government, government department undertake important task of seeking "the dynamic balance", such as maintain order, offer chance of foreign lawyer entering into market, service trade of law, reduce to national impact.更多还原
